<br />II <br />II <br /> <br />RESOLUTION NO. 85-54 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />...., <br />i <br />I <br />I <br />i <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NC-69. <br /> <br />WHEREAS, an application for a nonconforming use permit has <br />: been made by ACG, Inc.; and <br /> <br /> <br />WHEREAS, the procedural history of the application is as <br />'follows: <br /> <br />1. That an application for a nonconforming use permit was <br />filed with the City on May 5, 1985. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on May 21, 1985, <br />all person's present at the hearing were given an <br />opportunity to be heard. i <br />3. That the application for a nonconforming use permit, NC-691 <br />was reviewed by the City Council on May 28, 1985 and that I <br />the comments and analysis of staff and the Planning Com- <br />mission minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that <br />the following Findings of Fact are made in respect to NC-69: <br /> <br />1. That the existing Type IV nonconformities are: <br />a. Less than required front yard parking setback; <br />b. Lack of front yard landscaping; <br />c. Lack of designated employee parking; <br />d. Lack of concrete curbing; <br />e. Larger than permitted driveway widths; and <br />f. Raw block front fa cade. <br />2. That the applicant has eliminated or reduced all of the <br />Type IV nonconformities by the following: <br />a. Providing the required front yard landscaping and <br />parking setback; <br />b. Installing concrete curbing in the front yard setback; <br />c. Providing designated employee parking with the <br />required number of parking stalls; <br />d. Reduce the driveway widths to 36 feet and provide <br />the required curb radii; <br />e. Landscaping and fencing around outside storage yard; <br />and <br />f. Paint the building. <br />3. That the conditions of Section 8-460, Type IV non- <br />conformities have been met. <br /> <br />BE IT FURTHER RESOLVED that the application NC-69 is and <br />hereby approved subject to the following conditions: <br /> <br />1. That the drivewaysbe asphalted up to the front <br />building setback. <br />2. That fill placed on the site by the applicant be <br />removed by Oct-oberl, 1985 to meet the requi rements of Ri ce <br />Creek Watershed District and the City Engineer, and a <br />fill permit be obtained from the City of New Brighton. <br />3.
