<br />u ~ <br />II <br /> <br />RESOLUTION NO. 85-52 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-242. <br /> <br />!l <br />!I <br />!I <br />:] <br />;, <br /> <br />WHEREAS, an application for a variance has been made by <br />Mike Rasmussen and Don Dickison; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />I, <br />:1 <br /> <br />l. <br />2. <br /> <br />That an application for a variance was filed <br />with the City on May 5. 1985. <br />That the Planning Commission. pursuant to I <br />and mailed notices. held a public hearing <br />1985, all person1s present at the hearing I! <br />an opportunity to be heard. <br />That the application for a variance. VN-242 was re- I <br />viewed by the City Council on May 28. 1985 and that I <br />the comments and analysis of staff and the Planning , <br />Commission minutes and recommendations were considered. I <br /> <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />! <br />I <br />I <br />i <br />I <br />I <br /> <br />published <br />o n May 21, <br />were given <br /> <br />3. <br /> <br />WHEREAS. the property is legally described as follows: <br /> <br />That part of the S 1/2 of the S 1/2 of the SE 1/4 <br />of the SW 1/4 of Section 29. Town 30, Range 23. <br />Ramsey County. Minnesota lying West of the West <br />right-of-way line of County Road No. 77 (formerly <br />State Highway No.8) and lying East of the following <br />described line: Beginning at a point on the South <br />line of saidS 1/2 of the S 1/2 of the SE 1/4 of the <br />SW 1/4 distant 728.19 feet East of the Southwest <br />corner thereof; thence North 19051'4111 West (assumed <br />bearing of South line of said S 1/2 of the S 1/2 of <br />the SE 1/4 of the SW 1/4 is North 890 3814911 West) <br />a distance of 132.74 feet; thence Northwesterly to a <br />point on the North line of said S 1/2 of the S 1/2 of <br />the SE 1/4 of the SW 1/4 distant 535.37 feet East of <br />the Northwest corner thereof and said line there ter- <br />minating. Subject to 1st Street NW. <br /> <br />1 . <br />2. <br />3 . <br /> <br />I <br />I <br />I <br /> <br />I <br />I <br /> <br />That the required side street yard setback from I' <br />1st Street NW is 60-feet. <br />That the applicant is requesting a 20-foot variance I <br />to allow a 40-foot building setback on 1st Street NW. I <br />That there exists the following unique and unusual cir- <br />cumstances. unique to the property. that hinder develop <br />ment of the site without the requested variance: <br />a. The eastern property line of the site is the <br />centerline of County Ditch #2 which reduces the <br />buildable area of the site. <br />b. The site is bordered by County roads on two sides <br />requiring additional land for building setbacks. I <br />again reducing the buildable area of the site. <br />c. The triangular shape of the property is unusual and I <br />reduces the possible number of building layouts. I <br />d. That both County road right-of-ways are larger I' <br />than the standard street right-of-ways of 60-feet I <br />(1st Street NW is 80-feet and Old Highway 8 is 89.5 <br />feet) . i <br />I <br />i <br />! <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to VN-242: <br /> <br /> <br />
