Ii <br /> <br />;:. <br /> <br />RESOLUTION NO <br /> <br />85-51 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />, RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />i NC-70 <br /> <br />WHEREAS, an application for a nonconforming use permit has <br />been made by Mike Mezzenga; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a nonconforming use permit was <br />filed with the City of New Brighton on May 5, 1985. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on May 21, 1985, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That the application for a nonconforming use permit, <br />NC-70 was reviewed by the City Council on May 28, 1985 <br />and that the comments and analysis of staff and the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-70: <br /> <br />1. That the site presently has the following Type IV non- <br />conformities: <br />a. Less than required front yard setback (13.4 feet). <br />b. Less than required side yard setback (2.2 feet). <br />2. That the applicant proposes to reduce the extent of <br />the Type IV nonconformities by doing the following: <br />a. Removing the southern most 14 feet of the existing <br />home to increase the front yard setback to 22 feet. <br />b. Removing the 5 foot by 3 foot addition off the west <br />side of the house. <br />c. Constructing the new building addition to conform to <br />the current zoning setback requirements. i <br />3. T hat the a p p 1 i can tis red u c i n g the e x ten t 0 f the ex i s tin gi <br />Type IV nonconformities where practical and is reducing I <br />the impact of the existing Type IV nonconformities on I <br />adjacent premises by increasing the front yard setback ! <br />to provide better on-site parking. <br /> <br />BE IT FURTHER RESOLVED, that the application NC-70 is <br />hereby approved subject to the following condition: <br /> <br />1. That the southern 14 feet of the existing structure and <br />5 foot x 3 foot addition off the west side of the <br />existing structure be removed within two months of <br />'i completion of the new addition off the north side <br />I of the existing structure. <br /> <br />\; <br />Adopted this 28th day of May, 1985. <br /> <br />~/!>~ <br /> <br />Greg y .
