<br />I, <br />IJ <br /> <br />~ <br /> <br />RESOLUTION NO. <br /> <br />85-48 <br /> <br />II <br />i; RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PUD-3 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />WHEREAS, an application for a Planned Unit Development has been made by <br />:! Edwin Taylor; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for a Planned Unit Development was filed with <br />the City on March 29, 1985, <br />2. That the Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on May 21, 1985, all persons present <br />at the hearing were given an opportunity to be heard, and: <br />3. That the application for PUD approval was reviewed by the City Council! <br />on May 28, 1985, and that the comments and analysis of Staff and the <br />Planning Commission minutes and recommendations were considered. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council that the following <br />Findings of Fact are made in respect to PUD-3: <br /> <br />3. <br /> <br />1 . That the property <br />2. That the property <br />Highway 96, north <br />west of I-35W, <br />That site is underutilized with present land uses of a construction <br />yard, small industrial buildings, non-conforming residential homes, <br />and vacant land, <br />That surrounding land uses include industrial to the north and south, <br />I-35W freeway to the east, and Ramsey County Long Lake Regional Park <br />to the west, <br />That the proposed PUD is consistent with the New Brighton Comprehen- <br />sive Plan which states that the site should be developed as an <br />industrial or regional commercial use, <br />6. That the proposed PUD is compatible with surrounding land uses, will <br />be attractive in environmental and aesthetic design, and will not <br />negatively impact the Ramsey County Regional Park, <br />That the existing public utilities and adjacent county and state <br />roads are adequate to serve the development, <br />8. That there will be no burden or impact created by the proposed PUD <br />on parks, schools, streets, or other publiC utilities, and <br />That the proposed uses within the PUD are office/warehouse and do not <br />include outside storage, chemical storage, or heavy manufacturing. <br /> <br />is zoned I-1 light industrial, <br />is 9.7 acres in size and is located south of <br />of Lowy Enterprises, east of Old Highway 8, and <br /> <br />4. <br /> <br />5. <br /> <br />7. <br /> <br />9. <br /> <br />BE IT FURTHER RESOLVED that the application PUD-3 is hereby approved <br />subject to the following conditions: <br /> <br />1., Approval of PL..140, <br />2. That all grading and drainage plans be approved by Rice Creek Water- <br />shed Distri'ct and the City Engi neer, <br />3. That all curb cuts be approved by Ramsey County, <br />4. That a sign plan for the development be approved by special use <br />permi't, <br />5. Approval of all fire hydrant locations and fire access by the Fire <br />Chtef, and <br />6.
