<br />~~ ,,,~"4 " <br /> <br />t:; <br /> <br />RESOLUTION NO 85-37 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION APPROVING SUBDIVISION OF CERTAIN PROPERTY WITHIN THE <br />CITY OF NEW BRIGHTON (generally north of View Avenue and North <br />of Old Highway 8) <br /> <br />WHEREAS, the City of New Brighton has been requested to <br />subdivide certain property in the City of New Brighton <br />described as follows: <br /> <br />TRACT A <br /> <br />That part of the South 50 acres of the North ! of the <br />Southeast 1 of Section 17~ Township 30, Range 23, Ramsey <br />County, Minnesota, described as follows: Beginning at a <br />point on the East line distant, 773.0 feet South of the <br />Northeast corner of said Southeast 1; thence West a distance <br />of 438.1 feet along a line which if extended to a point <br />1000.0 feet West of said East line of the Southeast! <br />would intersect a line drawn parallel with and 771.3 feet <br />South of the North line of said Southeast !; thence South <br />parallel with the East line of said 50 acres a distance of <br />288.1 feet; thence East 438.1 feet parallel with the above <br />described first course to the East line of said South 50 <br />acres; thence North along said East line 288.1 feet to the <br />point of beginning, subject to the rights of the public <br />over the North 33 feet thereof for road purposes. <br /> <br />TRACT B <br /> <br />The South 50 acres of the North ! of the Southeast 1 of <br />Section 17, Township 30~ Range 23 except part conveyed to <br />the United States of America in 1100 Deeds 295, except <br />,. that part described as follows: Beginning at a point on <br />the East line distant 495 feet South of the Northeast <br />corner of said Southeast i; thence West parallel with the <br />North line of said Southeast 1 a distance of 700 feet; <br />thence South at right angles 120 feet; thence West at <br />right angles 300 feet; thence South at right angles 156.3 <br />feet; thence East 1000 feet to a point on the East line of <br />said South 50 acres distant 278 feet South of the above <br />described point of beginning; thence North along the East <br />line thereof. 278 feet to the point of beginning and <br />except that part of the South 50 acres of the North! of <br />the Southeast 1 of Section 17~Township 30, Range 23, Ramsey <br />County, Minnesota, described as follows: Beginning at a <br />point on the East line distant, 773.0 feet South of the I <br />Northeast corner of said Southeast 1; thence West a distancel <br />of 438.1 feet along a line which if extended to a point i <br />1000.0 feet West of said East line of the Southeast 1 would I <br />intersect a 1 i ne drawn parall el wi th and 771.3 feet South ' <br />of the North line of said Southeast !; thence South parallell <br />with the East line of said 50 acres a distance of 288.11 <br />fee t; the n c e E a s t 4 3 8 . 1 fee t par a 11 e 1 wit h th e a b 0 v e ! <br />described first course to the East line of said South 50 <br />acres; thence North along said East line 288.1 feet to the <br />point of beginning. <br /> <br />WHEREAS, State Statutues require that if such property is i <br />located in municipalities that have adopted a platting ordinance,! <br />approval of that municipality must be obtained before such <br />subdivisions can be filed, and <br /> <br />'. <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code <br />provides for subdivision of property without platting if certain <br />criteria can be met; and <br /> <br />WHEREAS, the City Council has determined that such criteria <br />has been met. <br />
