<br />r <br /> <br />ORDINANCE NO. 680 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />AN ORDINANCE ADOPTING THE RECODIFICATION OF THE <br />NEW BRIGHTON ZONING CODE AND APPROVING A SUMMARY <br />THEREOF FOR PUBLICATION <br /> <br />, 'THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS as follows: <br /> <br />1. Background <br /> <br />1.1. Minnesota Statutes, Sections 415.02, 415.021 and 599.13 authorize the City to codify its j <br />ordinances and print them in book or loose leaf form, and provide that any ordinance <br />included in a new code but not previously published is sufficiently published if a substantial <br />quantity of the code is printed for distribution to the general public. <br /> <br />The City has completed a recodification ofthe Zoning Code of the City, which was <br />prepared in house by City staff with assistance from the City Attorney, and which <br />incorporates ordinances through Ordinance Number 677. <br /> <br />1.2. <br /> <br />1.3. The City Council has reviewed the proposed recodification of the City's Zoning <br />ordinances in a recodification entitled The New Brighton Zoning Code of2001 <br />(Recodification). The Recodification is on file with the City Finance Director/Clerk. <br /> <br />1.4. Minnesota Statutes, Section 412.191, Subd. 4 allows publication by title and summary in <br />the case of lengthy ordinances or those containing charts or maps. The Council finds: <br />that the summary of the Recodification contained herein would clearly inform the public <br />of the intent and effect ofthe Recodification; that the Recodification is lengthy; and that <br />publication by summary is appropriate. <br /> <br />; 2. Summary of Recodification. The Recodification incorporates ordinances through Ordinance No. <br />677 into the City's Code and makes changes that are summarized as follows: <br /> <br />2.1. The entire Code has been reformatted to a uniform numbering system. <br /> <br />2.2. The text has been modified to be gender neutral. <br /> <br />2.3. References to Minnesota Statutes and Rules have been updated. <br /> <br />2.4. Various fees set by ordinance were deleted and are now to be set by Council resolution. <br /> <br />2.5. In many cases the assignment of duties to specific staff positions have been deleted to <br />reflect administrative reorganizations and to allow flexibility in staff duty assignments. <br /> <br />2.6. Many changes in grammar, punctuation and form have been made, not affecting or <br />altering the substances of the Code. <br /> <br />3.
