<br />WITNESSETH:

<br />!i WHEREAS, by its Resolution No. 2490, adopted August 20, 1981,
<br />,I the New Brighton city Council levied a special assessment in the
<br />Ii amount of $121,063.71 at the rate of $132.19 per lineal foot of
<br />~ frontage for the opening of 9A Str,et and the installation of
<br />I.:.'. sanitary sewer, watermain, water aQ.d sewer services, storm se\ver,
<br />!~ concrete curbing and bituminous surfacing as it pertains to the
<br />I' following described real property 8i tuated in the City of New
<br />'i Brighton, Ramsey County, Hinnesota, to-wit:

<br />feet; the East 519.52 feet of the North half of
<br />the Northeast Quarter of the Northwest Quarter
<br />(Subject to Roads and Easements) in Section 29,
<br />Range 30, Township 23; and

<br />II WHEREAS pursuant to the provi$ions of Hinnesota Statutes,
<br />i1 Section 429.071, Subdivision 2 thereof, the New Brighton City
<br />Ii Attorney has advised the city that part of the above-described
<br />!l special assessment is excessive and, therefore, invalid; and
<br />
<br />!l ~'I]'I-IEREAS, the fee owner at: record of 'the above-described
<br />q
<br />~. property has perfected an appeal pursuant to the provisions of
<br />II Minnesota Statutes, Section 429.08l thereof, from th~ above-
<br />Ii referenced special Cj.ssesspent to the R.amseyCountyr District Court;

<br />WHEREA.8, said pending appeal has been disltl,issed pursuant to
<br />I the pr6visions of the StipUlation of Settlement and Dismissal by
<br />I and between the City and said owners whereunder it was agreed that
<br />I,l!. the City would set aside the existing assessment of $121,063.71
<br />I against~'the above-described property-and reassess that same prop-
<br />n
<br />,: erty in the gross amount of $73,264.00 or $80.00 per lineal foot
<br />II assuming 915.8 assessable lineal f,et; and

<br />WHEREAS, pursuant to the provisions of said Stipulation of
<br />Settlement and Dismissal, the Appellants/Owners waive any further
<br />notice and/or hearing as provided in said Minnesota Statutes,
<br />Section 429.071, Subdivision 2 the~eof, and consent to the re-
<br />assessment of the above-described real property in the gross
<br />amount of $73,264.00 at the rate of $80.00 per lineal foot assum-
<br />ing 915.8 assessable lineal feet.
