<br />RESOLUTION MAKING FINOINGS OF FACT AND APPROVING APPLICATION FOR
<br />SPECIAL USE PERMIT, SP-100
<br />
<br />WHEREAS, an application for a special use permit entitled
<br />SP-100 has been made by RCE Corporation to establi$h ~ sign plan
<br />for the Rice Creek Center; and .
<br />
<br />WHEREAS, the procedural his~ory of the application is as
<br />follows:
<br />
<br />1. That an application for ~pecial use permit, SP-l00 was
<br />filed with the City of N~w Brighton on October 6, 1981.
<br />2. That the Planning Commis~ion, pursuant to published
<br />and mailed notices, held,a public hearing on October 20,
<br />November 17, 1981, December 15, 1981 and January 19,
<br />1982, all person's preserit at the hearing were given an
<br />opportunity to be heard.
<br />3. That such application wa$ reviewed by the City Council
<br />on January 26, 1982.
<br />4. The written comments and:analysis of the city staff,
<br />the Planning Commission minutes and recommendations
<br />were considered.
<br />
<br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City
<br />Council makes the following Findihgs of Fact in respect to SP~O~
<br />
<br />1. That the property is zoned B-3, General Business and
<br />developed as a shopping center;
<br />2. That the City in regard to signage has designated this
<br />site asan area of special control (Section 9-180
<br />Zoning Code); ,
<br />3. That the City byspecial' permit may establish special
<br />sign regulations that ar~ more or less restrictive than
<br />the reg u 1 a t ion sin the t!a b 1 e 0 f Bas i c 0 e s i g n E 1 em e n t s ;
<br />4. That the proposed sign plan is comprehensive in nature
<br />and addresses the needs of the intensive commercial
<br />activities on this site;
<br />5. That the proposed sign plan is consistent and
<br />compatible with the basic intention of the sign
<br />ordinance in that it reduces clutter, provides sound
<br />identification and is a~sthetically pleasing.
