The procedural history of the application <br />follows: <br /> <br />is as <br /> <br />1. That an application for non-conforming use variance, NC-53 <br />was filed with the City of New Brighton on October 2, 1981. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on November 17,1981. <br />all person1s present at the hearing were given an <br />opportunity to be heard. <br />3. That such application was considered by the City Council <br />o n Nove m be r 2 4, 1 9 81 . <br />4. That the property is zoned B-1, Limited Business and that <br />the maximum allowed area for a ground sign in that <br />district is 36 square feet; <br />2. That the existing sign is 56 square feet and was allowed <br />for a five year period under Council approved VN-160 on <br />October 12, 1965; <br />3 . That the f i v e ye a,r,.pe,r io d has expired and the a p p 1 i can tis <br />proposing to replace the' 56,square foot sign with a sign <br />that is 38.5 square feet; <br />4. That the proposed sign is an existing sign already owned <br />by the company; . , <br />5. That the new sign exceeds,theallowedarei:l2.5 square feet <br />and meets the intention of VN-160; <br />6. That it would be a hardshtp to require a custom IDade sign <br />when the proposed ,sign is IDore conforming "than the existing <br />one; and <br />7.
