That an application for non-conforming use variance was filed with <br />the City of New Brighton on July 30, 1981. <br />2. That such application was reviewed by the New Brighton Planning <br />Commission Board of Review on August 6, 1981. <br />3. That the City Council, pursuant to\published and mailed notices, held <br />a public hearing on August 25,1981, 'all person's present at the <br />hearing were given an opportunity to be heard. <br />4. The written comments and analysis of the City staff, the Planning <br />Commission minutes and recommendations were considered. <br /> <br />1 <br />I <br />I <br />,I <br />Ii <br />I! <br />" <br />Ii Nm1 THEREFORE BE IT RESOLVED, That the New Brighton City Council makes <br />Ii the following Findings of Fact in respect to NC-51: <br /> <br />I <br />I <br /> <br />I <br />.l <br /> <br />1. That the property is zoned R-l, Single Family Residential; <br />2. That the existing house has a side street yard setback of 10.5 feet <br />and the zoning code requires a 15 foot setback; <br />3. That the lot is unique in that it has a rear yard slope that restricts <br />the development of a detached garage; <br />4. That the cQnstructionof a detached garage could negatively affect <br />the adjacent property owner's view of the City park; <br />5. That a hardship would result if the applicant were unable to have a <br />two car garage which is a typical accessory building in an R-l <br />district; <br />6. That the proposed zoning code approved by the City Council provides <br />for special consideration for setbacks on corner lots on the basis <br />of visual compatibility; and . <br />7. That the access (driveway) off of 5th Street NW be approved by the <br />City Engineer; <br />2. That the attached garage architecturally match the existing structure; <br />and <br />3.
