<br />H WHEREAS, The City of New Brighton has'been petitioned tq vacate certain

<br />i'~ NOW THEREFORE BE IT RESOLVED, That the New Brighton City Council makes the
<br />II following Findings of Fact in respect to the proposed vacation:
<br />
<br />I! 1. That the original Cleveland Avenue right-of-way serves a different
<br />traffic service than at this time;
<br />2. Thatth~re are no plans to widen the improved portion of the street;
<br />3. That the right-of-way to be vacated is therefore excessive and
<br />serves no public function; and
<br />4. That a sanitary sewer easement has been provided by Mr. Lange.
<br />
<br />WHEREAS, The procedural history of the vacation proceediflgs is as follows:
<br />
<br />1. That the property owner adjacent to the street has r~quested the
<br />vacation by a letter dated March 4, 1981.
<br />2. That 'Such petition was reviewed by the New Brighton Planning
<br />Commission Board of Review on March 17, 1981.
<br />3. That the City Council, pursuant to published and mailed notices, held
<br />a public hearing on April 14, 1981, all person's present at the
<br />hearing were given an opportunity to be heard.
<br />4. The written comments and analysis of the City staff, the Planning
<br />Commission minutes and recommendations were considered.

<br />1: BE IT FURTHER RESOLVED That the petiti on for vacati on is and hereby approve
<br />!l subject to the applicant dedicating a sanitary sewer easement to the City of
<br />.\ New Brighton. The Oouncil hereby approves the vacation of the following
<br />i described right-of-way:

<br />Commence at the SE corner of Section 29, Town 30 North, Range 23 West,
<br />Ramsey County, Minnesota; thence North along the East line of said
<br />Section 29 a distance of 881.47 feet; thence North 88015' West 942.44
<br />feet; thence Northwesterly on the North right-of-way line of a County
<br />highway, known as Cleveland Ave. as located and recorded in the Register
<br />of Deeds, Ramsey County, in Book 826 Deeds, Page 613, on a curve to the
<br />right radi us 333. 57 feet a .di stance6f" 134 :-66 feet ;' thence North arid
<br />parallel to theosaid East line of Sectton29 a distance of 170 feet;
<br />thence North 88151 West adi stance of 165 J.feet to' the right-of-way. line
