'~'i.. .. .- r I I ------ CITY OF NEW BRIGHTON COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE RELATING TO TOBACCO LICENSING; REPLACING CHAPTER 15, ARTICLE IV OF THE NEW BRIGHTON CODE OF ORDINANCES THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS that the New ;, Brighton Code of Ordinances is amended by deleting Chapter 15, Article IV in its entirety and replacing it with the following language: ARTICLE IV. TOBACCO Sec. 15-55. License required. No person shall directly or indirectly or by means of any device keep for retail sale, sell at retail, or otherwise dispose of tobacco at any place in the city unless a license therefor shall first have been obtained as provided in this article. Sec. 15-56. Definitions. Tobacco shall mean cigarettes; cigars; cheroots; stogies, perique; granulated, plug cut, crimp cut, ready rubbed, and other smoking tobacco: snuff, snuff flour; cavendish; plug and twist tobacco; fine cut and other chewing, tobaccos; shorts; refuse scraps, clippings, cuttings and sweepings of tobacco and other kinds and forms of tobacco, prepared in such manner as to be suitable for chewing, or smoking in a pipe or other tobacco-related devices. .. Sec. 15-56. Application. Application for a license required by the provisions of this article shall be made to the city clerk on a form supplied by the city. Such application shall state the full name and address of the applicant, the location of the building, and the part intended to be used by the applicant under such license, the kind of business conducted at such location, and such other information as shall be required by the application form. Sec. 15-57. License fee. The fee for every license required by the provisions of this article shall be specified by council resolution. For any license issued after April first in any year, the full fee shall be paid. Sec. 15.58. Issuance. Upon the filing of an application for a license required by the provisions of this article, the city clerk shall present such application to the city council for its consideration and, if granted by the council, shall issue such license upon the payment of the required fee.
