<br />,-. . <br /> <br />ORDINANCE NO. 636 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING THE "MUNICIPAL CODE OF THE CITY OF NEW BRIGHTON, <br />MINNESOTA" REGULATING THE LOCATION OF COURTESY BENCHES AND PROVIDING FOR AN <br />APPLICATION AND INSPECTION FEE. <br /> <br />The Council ofthe City of New Brighton does ordain: <br /> <br />1 . The following Article VI is added to Chapter 25 of the City Code The following Chapter is <br />hereby added to the City Code: <br /> <br />ARTICLE VI. COURTESY BENCHES. <br /> <br />Sec. 25-120. PURPOSE <br /> <br />The placement of courtesy benches on the public right-of-way in some locations provides a public <br />amenity. However, such benches increase visual clutter thereby decreasing property values and are <br />inconsistent with the character of the neighborhood, are inconvenient for maintenance of lawn or <br />landscaping, and may create distractions or hazards to traffic and unsafe conditions for pedestrians. <br />Therefore, the Council finds it necessary and appropriate to weigh these conflicting public policy <br />objectives and regulate the placement of such courtesy benches in the City. <br /> <br />Sec. 25-121 PERMIT REQUIRED. <br /> <br />No person shall place or maintain any bench or seat on any public sidewalk or right of way within the <br />City of New Brighton unless they shall have obtained a pennit and have complied with the provisions of <br />sections inclusive ofthis Article. <br /> <br />Sec. 25-122. PROCEDURE FOR ISSUANCE OF PERMITS. <br /> <br />A permit to install and maintain a bench on and along any public sidewalk or right of way may be <br />issued by the City Council to a person by complying with the following requirements: <br /> <br />(a) The application for such permit shall be in a fonn detennined by the City Manager and shall <br />contain the location, detailed plans and specifications of each proposed bench and such other <br />infonnation as shall be required by the City Manager. <br /> <br />(b) The location of each bench shall be placed at a designated pickup location for the public transit <br />route. Other locations that are deemed to be in the public interest may be approved by the City <br />Manager. <br /> <br />(c) Each application shall be accompanied by a letter of consent in such fonn as the City Attorney <br />shall require, signed by the owner(s) or lessee(s) of the property adjacent to the portion ofthe <br />street or sidewalk where each bench is proposed to be located giving such owners' or lessees' <br />consent to the installation and maintenance of such bench at the proposed location. The <br />applicant shall furnish therewith such evidence of ownership or lease as shall be required by the <br />City Attorney. <br />
