<br />i <br />ii' <br />~1. <br /> <br />~r <br />t <br /> <br />ii <br />;j <br /> <br />ORDINANCE NO. 631 <br /> <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />1; <br /> <br />AN ORDINANCE AMENDING CITY CODE BY ADDING NEW SECTION 18-5.5 AN <br />ORDINANCE RELATING TO THE USE OF PUBLIC PROPERTY. <br /> <br />Section 18-5.5. Rules Governing the Use of City Property <br /> <br />(a) <br /> <br />The City Council finds that it is necessary that functions and proceedings of the City remain <br />free from organized or calculated confusion, disturbances or delay; that free, proper and <br />lawful access to, egress from and proper use of public property be protected; that the conduct <br />of public business on public property free from interferences or disruption or the threat <br />thereof be protected; that employees and citizens be free to work and conduct their lawful <br />activities without unreasonable interference or annoyance, delay, harassment, intimidation, <br />disturbance, fear, unwanted advances, disruption, oppression, or persecution; and that public <br />property be protected from damage or destruction. <br /> <br />ii, <br />l! <br /> <br />(b) To these ends the Manager shall have supervision over the buildings and other property <br />owned by or under the control of the City. The Manager is authorized, pursuant to Minnesota <br />Statutes Sections 624.72, 412.211, and 412.221, Sd. 3, to promulgate reasonable rules and <br />regulations for the governing of such public property. The Manager or the Manager's <br />authorized designee shall enforce such rules and regulations and is authorized to take all <br />reasonable and necessary action to achieve and secure compliance. <br /> <br />(c) <br /> <br />Persons not abiding by such promulgated regulations shall be asked to leave the premises. <br />The Manager or the Manager's designee may revoke or suspend such person's privilege of <br />access to such public property. The Manager or Manager's designee may make continued use <br />of the public property, subject to reasonable conditions. A person whose privilege has been <br />revoked or suspended or made subject to conditions by the Manager's designee, may appeal <br />such action to the Manager, whose decision shall be final. <br /> <br />:! <br /> <br />(d) It is unlawful for a person to remain on the premises of public property after demand is given <br />that such person leave by the Manager or the Manager's designee or to return to <br />such premises after having been directed to leave without first having obtained permission <br />by the Manager or Manager's designee to re-enter upon such premises. <br /> <br />(e) Violation of rules and regulations which have been published, posted, or announced in <br />a reasonable manner at the time of such violation is a violation of this section and of <br />Minnesota Statutes, Section 624.72. <br /> <br />This ordinance shall become effective on the day following publication. <br />
