<br />d <br /> <br />---'. <br />;, <br /> <br />ii <br />I; <br /> <br />... <br /> <br />,; <br /> <br />RESOLUTION NO. 2360 <br /> <br />ii. <br />. ~ <br /> <br />!i <br />II <br />p <br />H <br />I: <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />i; <br /> <br />., <br />" <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />, NON-CONFORMING USE PERMIT, NC-45 <br /> <br />WHEREAS, An application for a non-conforming use permit <br />entitled NC-45 has been made by Micom Inc., to permit the <br />construction of an industrial building on a site with existing <br />Type IV non-conformities; and <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for non-conforming use permit NC-45 <br />was filed with the City of New Brighton on June 6, 1980. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on June 17, 1980 <br />and July 15, 1980. <br />3. That the City Council, pursuant to published and mailed <br />notices, held a public hearing on August 12, 1980, all <br />persons present at the hearing were given an opportunity <br />to be heard. <br />4. The written comments and analysis of the city staff, <br />the Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to NC-45: <br /> <br />1. That the property is zoned I-2, Heavy Industriali <br />2. That the site has the following Type IV non-conformities <br />A. Less than 40' front yard setback; <br />B. Less than 15' side interior yard setback; <br />C. Less than required side street yard landscaping; <br />D. Side street yard parking; <br />E. Parking within 15' of a street right~of-way; <br />F. Driveway along Old Highway #8 is located less than <br />50' from the intersection of the street right-of-way <br />3. That under NC-32 approved by the City Council on <br />October 10, 1978 the applicant did everything practical <br />to address the non-conformities and said measures were <br />completed in 1979i <br />4.
