State of Minnesota County of Ramsey City of New Brighton , AN ORDINANCE RELATING TO THE LICENSURE OF THERAPEUTIC MASSAGE SALONS; AMENDING NEW BRIGHTON CITY CODE SECTIONS 15-181, 15-182, 15-183, 15- 184, 15-185, 15-197, 15-198, 15-207 AND 15-199 THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS AS FOLLOWS: Section 1. New Brighton Code Section 15-182 is amended by adding new paragraph (1) as follows: (1) Bona fide health club facilities: Those parts of any premises which are designed and used primarily for health and fitness activities and which have a caoital investment of at least Two Hundred Fifty Thousand Dollars ($250.000) in buildiUl!S and fixtures and at least Twenty Thousand Dollars ($20,000) in exercise equipment. Section 2. New Brighton Code Section 15-183 is amended as follows: It shall be unlawful for any person, directly or indirectly, upon any pretense or by any device within the city, to operate any service in conjunction with the operation of an escort selVice, therapeutic massage jffifler salon, rap parlor or sauna parlor for which any charge or fee is made or any money or thing of value is solicited or received without being licensed therefor by the city; except the license requirements herein shall not apply to the practice of medicine, surgery, osteopathy, chiropractic, physical therapy or podiatry by persons duly licensed or registered in this state to practice medicine, surgery, osteopathy, chiropractic, physical therapy or podiatry, and nurses who work solely under the direction of any such person, nor to barbers-tl:ft6., beauticians and manicurists who are duly licensed under the laws of this state, except that this exemption shall apply solely to the massaging of the neck, face, hands, feet, scalp and hair of the customer or client for cosmetic or beautifying purposes. The provisions of this Article do not applv to massages or massage selVices at bona fide health club facilities orovided massages are conducted in an open. public area of such facilities to which access is not restricted by sex and is not limited to adults, and massages are given to customers or clients who are fully and decently clothed. Section 3. New Brighton City Code Section 15-199 is amended as follows: (a) A business license for businesses other than therapeutic massage salons shall be issued only for property zoned B-3, General Business; 1-1, Light Industrial; or 1-2, Heavy Industrial; provided that such use is not detrimental to existing and future CLL96308 NE136-8 I
