<br />~,."- <br /> <br /><t. <br /> <br />,. <br /> <br />.~ I <br /> <br />ORDINANCE NO. 619 <br /> <br />f '. <br /> <br />State of Minnesota <br />County of Ramsey <br />City of New Brighton <br /> <br />, <br /> <br />AN ORDINANCE RELATING TO THE LICENSURE OF <br />THERAPEUTIC MASSAGE SALONS; AMENDING NEW <br />BRIGHTON CITY CODE SECTIONS 15-181, 15-182, 15-183, 15- <br />184, 15-185, 15-197, 15-198, 15-207 AND 15-199 <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS AS FOLLOWS: <br /> <br />Section 1. New Brighton Code Section 15-182 is amended by adding new paragraph (1) <br /> <br />as follows: <br /> <br />(1) Bona fide health club facilities: Those parts of any premises which are designed <br />and used primarily for health and fitness activities and which have a caoital <br />investment of at least Two Hundred Fifty Thousand Dollars ($250.000) in <br />buildiUl!S and fixtures and at least Twenty Thousand Dollars ($20,000) in exercise <br />equipment. <br /> <br />Section 2. New Brighton Code Section 15-183 is amended as follows: <br /> <br />It shall be unlawful for any person, directly or indirectly, upon any pretense or by <br />any device within the city, to operate any service in conjunction with the operation of an <br />escort selVice, therapeutic massage jffifler salon, rap parlor or sauna parlor for which any <br />charge or fee is made or any money or thing of value is solicited or received without <br />being licensed therefor by the city; except the license requirements herein shall not apply <br />to the practice of medicine, surgery, osteopathy, chiropractic, physical therapy or podiatry <br />by persons duly licensed or registered in this state to practice medicine, surgery, <br />osteopathy, chiropractic, physical therapy or podiatry, and nurses who work solely under <br />the direction of any such person, nor to barbers-tl:ft6., beauticians and manicurists who are <br />duly licensed under the laws of this state, except that this exemption shall apply solely <br />to the massaging of the neck, face, hands, feet, scalp and hair of the customer or client <br />for cosmetic or beautifying purposes. The provisions of this Article do not applv to <br />massages or massage selVices at bona fide health club facilities orovided massages are <br />conducted in an open. public area of such facilities to which access is not restricted by <br />sex and is not limited to adults, and massages are given to customers or clients who are <br />fully and decently clothed. <br /> <br />Section 3. New Brighton City Code Section 15-199 is amended as follows: <br /> <br />(a) <br /> <br />A business license for businesses other than therapeutic massage salons shall be <br />issued only for property zoned B-3, General Business; 1-1, Light Industrial; or 1-2, <br />Heavy Industrial; provided that such use is not detrimental to existing and future <br /> <br />CLL96308 <br />NE136-8 <br /> <br />I <br />
