ORDINANCE NO. 555 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON AN ORDINANCE AMENDING SECTIONS 4-96, 4-106, 4-112, 4-115, AND 4-202 OF THE NEW BRIGHTON CITY CODE The New Brighton City Council does ordain: Section I. That Section 4-96, Sunday liquor sales, is hereby amended to read as follows: (1) Notwithstanding the provisions of Section 4-95, establishments to which lIon-salell licenses have issued or hereafter may be issued for the sale of intoxicating liquors which are hotels, motels, restaurants, or clubs which have facilities for serving not less than fifty (50) guests at one time, may serve intoxicating liquors between the hours of 12:00 noon and 12:00 midnight on Sunday in conjunction with the serving of food. (2) It is unlawful for any such establishment, directly or indirectly, to sell or serve intoxicating liquors as provided in subsection (1) above without having first obtained a special license therefor. Such special license may be issued by the council for a period of one (1) year and for which the fees shall be set by Council resolution. Application for said special license shall be made to the council in the same manner as application for other licenses to sell intoxicating liquor are made. That Section 4-106, Categories, is hereby amended to read as follows: There shall be four (4) categories of "on-salell liquor licenses authorized to be issued by the City. (a) Small restaurants: Small restaurants are restaurants having an interior pUblic area of not less than fifteen hundred (1,500) square feet and not more than two thousand four hundred and ninety-nine (2,499) square feet. (b) Medium restaurants: Medium restaurants are restaurants having an interior public area of not less than twenty-five hundred (2,500) square feet and not more than four thousand nine hundred and ninety-nine (4,999) square feet. (c) Large Restaurants: Large restaurants are restaurants having an interior public area of five thousand (5,000) or more square feet of interior public area. (d) Hotels and Motels: Hotels and motels are defined in Section 330.00, Subdivision 9, which have an interior public area of not less than four thousand (4,000) square feet. That Section 4-112, License fees, is hereby amended to read as follows: (l)The annual license fee for an "on-salell liquor license shall be set by Council resolution and shall be categorized as follows:
