<br />..' ., <br /> <br />I! <br />...~ <br /> <br />~.,> T.. +-, <br />c. ,~ .,. <br /> <br />ORDINANCE NO. 555 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING SECTIONS 4-96, 4-106, 4-112, 4-115, AND <br />4-202 OF THE NEW BRIGHTON CITY CODE <br /> <br />The New Brighton City Council does ordain: <br /> <br />Section I. That Section 4-96, Sunday liquor sales, is hereby <br />amended to read as follows: <br /> <br />(1) Notwithstanding the provisions of Section 4-95, <br />establishments to which lIon-salell licenses have <br />issued or hereafter may be issued for the sale of <br />intoxicating liquors which are hotels, motels, <br />restaurants, or clubs which have facilities for <br />serving not less than fifty (50) guests at one <br />time, may serve intoxicating liquors between the <br />hours of 12:00 noon and 12:00 midnight on Sunday <br />in conjunction with the serving of food. <br /> <br />(2) It is unlawful for any such establishment, directly <br />or indirectly, to sell or serve intoxicating <br />liquors as provided in subsection (1) above without <br />having first obtained a special license therefor. <br />Such special license may be issued by the council <br />for a period of one (1) year and for which the fees <br />shall be set by Council resolution. Application <br />for said special license shall be made to the <br />council in the same manner as application for <br />other licenses to sell intoxicating liquor are made. <br /> <br />That Section 4-106, Categories, is hereby amended <br />to read as follows: <br /> <br />There shall be four (4) categories of "on-salell <br />liquor licenses authorized to be issued by the <br />City. <br /> <br />(a) Small restaurants: Small restaurants are <br />restaurants having an interior pUblic area of <br />not less than fifteen hundred (1,500) square <br />feet and not more than two thousand four <br />hundred and ninety-nine (2,499) square feet. <br /> <br />(b) Medium restaurants: Medium restaurants are <br />restaurants having an interior public area <br />of not less than twenty-five hundred (2,500) <br />square feet and not more than four thousand <br />nine hundred and ninety-nine (4,999) square <br />feet. <br /> <br />(c) Large Restaurants: Large restaurants are <br />restaurants having an interior public area of <br />five thousand (5,000) or more square feet <br />of interior public area. <br /> <br />(d) Hotels and Motels: Hotels and motels are <br />defined in Section 330.00, Subdivision 9, <br />which have an interior public area of not <br />less than four thousand (4,000) square feet. <br /> <br />That Section 4-112, License fees, is hereby amended <br />to read as follows: <br /> <br />(l)The annual license fee for an "on-salell liquor <br />license shall be set by Council resolution and <br />shall be categorized as follows: <br />
