<br />". <br /> <br />.J." <br /> <br />I: <br /> <br />, , <br /> <br />. <br />~j <br /> <br />'---.,. <br /> <br />ORDINANCE NO. 5 54 <br /> <br />STATE OF MINNE$OTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING CHAPTER 23, ARTICLE I OF THE NEW BRIGHTON CITY CODE; <br />CONFERRING AUTHORITY TO ISSUE CITATIONS IN LIEU OF ARREST. <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW" BRIGHTON DOES ORDAIN: <br /> <br />SECTION 1. The Code of Ordinances of the City of New Brighton, <br />Minnesota, is hereby amended by adding a section, to be numbered 23-2, <br />which reads as follows: <br /> <br />Sec. 23-2. Authorization to Issue citations <br /> <br />(a) Except as expressly provided by this section, no <br />person other than a peace officer, constable, or part-time <br />peace officer may issue a citation in lieu of arrest or <br />continued detention, ask a person receiving a citation to <br />give a written promise to appear in court, or take a person <br />into custody as permitted by Minnesota Statutes Section <br />629.34. <br /> <br />(b) The City Sanitarian may issue a citation in lieu <br />of arrest where the City Sanitarian has probable cause to <br />believe that the person or corporation to whom the citation <br />is issued has violated the provisions of Chapters 6, 10, <br />11, 12, 13, 15, 17 or 27, of this Code, or any state <br />statute that relates to the same subject matter and <br />provides for a criminal penalty. <br /> <br />(c) The Community Development Director, City Planner <br />and/or Community Development Specialist may issue a <br />citation in lieu of arrest where the Community Development <br />Director, City Planner and/or Community Development <br />Specialist has probable cause to believe that the person or <br />corporation to whom the citation is issued has violated the <br />provisions of Appendix A to this Code. <br /> <br />SECTION 2.
