ORDINANCE NO 518 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON AN ORDINANCE AMENDING SECTION 7-030, SECTION 7-080, SECTION 8-320 SECTION 8-330, SECTION 8-620, SECTION 26-7 AND SECTION 26-24 OF THE NEW BRIGHTON CITY CODE The New Brighton City Council does ordain: SECTION I. That Section 7-030 (c)(19), Application, is hereby amended to read as follows: 9. An abstractors certificate showing the names and addresses of all property owners within six hundred (600) feet of the pro- posed planned residential development. SECTION II. That Section 7-080 (b), Public Hearing, is hereby amended to read as follows; I I l I; I" b. The public hearing shall be held after notice of the time and place of such hear- ings has been published in the official newspaper at least ten (10) days before the notice to be mailed to each of the owners of property within six hundred (600) feet of the property for which the planned residential development is requested, such notl..ce. s to be mailed at least ten (10) days I before the hearing, according to the abstractor's certificate provided by the I petitioner. I tl' ! : I j: SECTION III. That Section 8-320, Rezoning by Petition, is hereby amended to read as follows: i I I I I' i ~ Ii a. The planning commission shall, upon the petition of fifty (50) percent or more by number of the property owners within two hundred (200) feet of the property to be rezoned, fix a date for a public hearing. The petition shall be accompanied by an abstractor's certificate sho~ing the names of all property owners within three hundred fifty (350) feet of the property to be rezoned; and such petition and certificate wh&n filed with the city clerk shall be accompanied by payment of fifty dollars ($50.00) to defray the expenses of advertising, public hearing and other expenses incurred by the city in the handling of said petition. b. The planning commission shall hold at least one pUblic hearing on any petition for rezoning after published notice of the time and place at least ten (10) days before the hearing; and the planning commission shall also cause a notice to be mailed to each of the owners of property within three hundred fifty (350) feet of the property for whi0h rezoning is petitioned, such notices to be mailed to the last known addresses of the owners at least ten (10) days before the hearing. i; Ii " Ii I' !i t' ! ~ ) ; i ~ : i: i, ~ 1: I!
