<br />~ .,~ ~ <br />- - <br /> <br />~ ".- ~ <br /> <br />ORDINANCE NO. 522 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING SECTION 2-350 AND SECTION 4-550 OF THE NEW <br />BRIGHTON CITY CODE <br /> <br />The New Brighton City Council does ordain: <br /> <br />SECTION I. That Section 2-350, Home Occupations, is hereby <br />amended to read as follows: <br /> <br />SECTION 2-350 Definition. <br />An accessory use of a dwelling unit carried on <br />only by those residents of the dwelling unit <br />when the accessory use is conducted entirely <br />within the dwelling unit or when the dwelling <br />unit becomes the base of operation for the <br />accessory use. The use is clearly incidental <br />and secondary to the use of the dwelling unit <br />for residential purposes and does not change the <br />character of the residence or adversely affect <br />the residential character of the surrounding <br />neighborhood. <br /> <br />SECTION II. That Section 4-550, Home Occupation Ordinance, <br />is hereby amended to r~d as follows: <br /> <br />SECTION 4-550, Home Occupations. <br />a. The purpose of this section is to provide for <br />home occupations that conform to the standards <br />set forth in this section. The standards in <br />this section are intended to ensure that a <br />home occupation is clearly secondary and <br />incidental to the use of the dwelling unit <br />for residential purposes, and to ensure <br />compatibility of the home occupation with the <br />residential character of the neighborhood. <br />b. Permitted home occupations shall not include <br />the employment of more than one additional <br />person on site who does not reside on the <br />premises; and furthermore not more than one <br />room or twenty-five (25) percent of the gross <br />area of one floor, whichever is less, shall <br />be used to conduct such a home occupation. <br />The appearance of a residential dwelling shall' <br />in no way be changed or altered in a manner <br />which would cause the premises to differ from' <br />its residential character. <br />c. Activities resulting from the operation of a <br />home occupation shall be conducted entirely <br />within the enclosed area of a dwelling unit <br />or garage, shall have no exterior storage <br />of equipment or materials and furthermore <br />shall not include the exterior display of <br />anything except signs as are permitted by <br />Chapter IX. <br />d. Operation of any wholesale or retail business <br />shall not be permitted unless conducted en- <br />tirely by mail, and does not include the sale, <br />shipment, or delivery of merchandise on the ' <br />premises, except occasional sales shall be <br />permitted when such occasional sales are <br />incidental to and not the primary purpose of <br />the home occupation. <br />e. Not more than four additional vehicle trips <br />per day shall be generated by a home occupa- <br />tion. Any need for parking generated by the <br />conduct of such home occupation shall be met <br />off of the street only on the driveway of the <br />dwelling or in the garage and shall be con- <br />sistent with residential parking requirements. <br />
