The 1966 Code of Ordinances of the City of New <br />Brighton is hereby amended by adding Section l70 establishing a <br />procedure for deferral of special assessments for senior citizens <br />to read as follows: <br /> <br />section 170 - SENIOR CITIZEN ASSESSMENT DEFERRAL PROCEDURE <br /> <br />SECTION l70:,QQ 'Deferment of Special Assessments. The City <br />Council may in its discretion defer the payment of special <br />assessments heretofore or heretoafter adopted by the City of New <br />Brighton, when it determines by a three-fifths (3/5) vote of the <br />entire council that the property upon which said assessment has <br />been or is to be levied is homestead property, that one or more <br />of the owners of said property is sixty-fi~e (65) years of age <br />or older, and" that payment of said assessment would be a hardship <br />for the owner thereof. <br /> <br />SECTION 170:05. Hardship Defined. A hardship shall be <br />deembdj,to prima facie exist when the average annual payffient for <br />all assessments levied against the subject property exceeds one(l) <br />per cent of the adjusted gross. incom~ of the applicant as <br />evidenced by the applicant's most recent Federal Income Tax Return. <br /> <br />The average annual payment of an assessment shall be the <br />total cost of the assessment, interest not included, divided by <br />the number of years over which it is spread. <br /> <br />The City Council may consider assessment deferral for <br />eligible applicants not meeting the prima facie test of <br />Section 170:05. <br /> <br />othe <br /> <br />SECTION 170:10. Determination of Interest Rate. Deferred <br />assessments shall carry en interest rate equal to the interest <br />rate imposed on all other assessments for the same public <br />improvement. <br /> <br />SECTION l70:l5.
