Chapter <br />'I <br />!I: hereby amended by adding <br />I read as follows: <br /> <br />II Section 13-020 ~t Provisions <br /> <br />I! (e) Lots within a subdivision on plat recorded prior to <br />Irebruary 2, 1955, which are smaller in width or area than" the <br />, minimums set forth in this ordinance and are not within 75% of <br />I the minimum requirements of this ordinance may be utilized for <br />! single family detached dwelling purposes upon receiving special <br />Ii permission from the cit y Council. Such special permission may be <br />11 granted only after the City Council has considered all of the <br />Ii following factors: <br /> <br />II <br />II <br />~ I <br />II <br />II <br />L <br />I' <br />I <br />I <br />II <br />r <br /> <br />The New Brighton City Council does hereby ordain: <br /> <br />XIII of the New Brighton Z6ning Code is <br />thereto Section 13-020 (e) which shall <br /> <br />l. <br /> <br />Was the lot a platted lot of record on or before <br />February 2, 1955. <br />Is the adjacent land on both sides of the lot already <br />improved with principal structures. <br /> <br />2. <br /> <br />3. <br /> <br />Can the lot be improved with a single family detached <br />dwelling in compliance with all other applicable building <br />and zoning code provisions. <br /> <br />4. <br /> <br />Can the lot be improved with a single family detached <br />dwelling without the granting of any variances. <br /> <br />5. <br /> <br />Will development of the lot be detrimental to <br />surrounding lands. <br /> <br />6. Is the size of the lot compatible with other lot sizes <br />in the neighborhood. <br /> <br />II <br /> <br />i <br /> <br />7. Is the lot included in a taxing parcel with any other <br />land. <br /> <br />8. Is or has the lot been used in conjunction with other <br />adjoining land. <br /> <br />9. Has the owner of the lot taken voluntary actions which <br />knowingly created the situation requiring such special <br />permission. <br />
