<br />Section 2. Section 450 of the New Brighton Code of ordinance
<br />lis hereby amended as follows:

<br />) Section 1. Adoption of Fire Prevention Code. There is hereb
<br />i adopted by the City of New Brighton for the purpose of prescribing
<br />I regulations governing conditions hazardous to life and property
<br />from fire or explosion, that certain code known as the Fire
<br />,prevention Code recommended by the American Insurance Association,
<br />! being particularly the 1970 editionthEl,reof, aJ:1d the whole thereof,
<br />I including the October, 1972 rsvision of Articl,e '.31 thereof, save
<br />and except such portions as are hereinafter deleted, modified or
<br />'I amended (by section 2, :of this ordinan,ce,' of Whi"Ch cqdec,not less
<br />than three (3) copies have been and now are fileci in the office of
<br />Ij'the Clerk of the City of New Brighton and the same are hereby aciop ed
<br />,and incorporated as fully as if set out at length herein, and from
<br />the date on which this ordinance shall take effect, the provisions
<br />thereof shall be controlling within the limits of the City of New
<br />Br ight on .

<br />li Section 2. MOdifications, The Chief of the Bureau of Fire
<br />II Prevention shall have power to modify any of the provisions of the
<br />II Fire preven tion Code upon application in writing';by the owner or
<br />Ii lessee, or his duty authorized agent, when there are practical
<br />lldifficulties in the way of carrying out the strict letter of the
<br />licode, provided that the spirit of the code shall be observed,
<br />Ilpublic safety secured, and substantial justice done. The particuI
<br />I," of such modification when granted or allowed and the decision of
<br />I the Chief of the Bureau of Fire Prevention thereon shall be entere
<br />I! upon the records of the department and a signed copy shall be
<br />II furnished the applicant.

<br />~! Section 3. Appeals. Whenever the Chief of the Bureau of Fir
<br />II Prevention shall disapprove an f:ipplica tion or re;Euse to grant a
<br />permit applied for, or when it is claimed that the provisions of t €I
<br />code do not apply or that the true intent and meaning of the code
<br />have been misconstrued or wrongly interpreted, the applicant may
<br />I appeal from the decision of the Chief of the Bureau of Fire
<br />
