<br />The New Brighton Villagecauncil Does ordain:'
<br />
<br />SECTION 1. Sectian. 490:00 SuM. 3 of the 1966 ordinance
<br />Code of New Brighton, entitled, "private Residential Swimming
<br />Pool" is hereby amended to read as follows:
<br />

<br />Subd. 3. PRiVATE RES IDENTIAL SWIMMING POOL. Any swimming
<br />poal, as defined herein, intended to be used in connectianwJ.th a
<br />single family residence, andavailabls'only to the fam,ilyofthe
<br />househalder and his private guests.
<br />
<br />SECTION 2. Sectian 490:45 of the 1966 ordin~nc~, Code of
<br />New Brighton entitled "Poals located in other districts,~1ishereb
<br />amended to. read as follaws:

<br />SECTION 490:05 FENCING.A11 outdoor ingroundor partially
<br />inground (partially ingraund 1s defined toheightaf not more than
<br />3 feet above g.round)swimmi.ng pools existing and hereaftercortstruc ed
<br />shall he completely enclosed by a (non....c 1 imbing type of) fence or
<br />wall. All fence openings ar points of entry into the pool area
<br />enclosure shall be equipped with gates ~ " The fencean{lgates shall
<br />beat least five (5) feet in height anc}' ,shall be cons1::~ucted of
<br />materials approved by the BuildingInSlpectar~ All gates shall be
<br />equipped with self-closing' a,nd self-latching devices placed on
<br />the top of the gate or otherwise inaccessible to ,small children.
<br />All fence posts shall be decay or corrosion resistant and shall be
