<br />The New Brighton Village Council does hex;eby ordain:
<br />
<br />SECTION 1.
<br />
<br />.Defirfitions
<br />,
<br />
<br />
<br />A. Swirmning Pool. A swimming poolj.s any structure, basin
<br />chamber or tank containing an artificial body of water
<br />for swimming, diving or recreational bathing, more than
<br />150 square feet in area or over, 24 inches in depth,
<br />above or below ground.
<br />
<br />B. pUl:>lic Swimming Pool. Any swimming pOol, other than,a
<br />private residential swimming pool, intended to be used
<br />collectively by numbers of ~rsons for swimming or
<br />bathing operated by any personas defined herein,
<br />whether he be owner, lessee, 'operator licensee, or
<br />concessionaire, ",regardless 'Otwhathera fee is charged
<br />for such use.

<br />c.private Residenti~l Sw:i.min,ing, Pool. Any swimming pool
<br />located on private proper:ty under the control of the
<br />homeowne.r, or a homeown~r's'association, the use of which
<br />is limited to swimming orb~thing by members of his famil ,
<br />tenants, ,or their invited guests.

<br />D. HealthA'Uthority. The Village Health Office:t'or the
<br />Village Sanitarian.

<br />SECTION 2. All outdoor swimming ];>001'$ existing and hereafter
<br />constructedShal). be completely enclosed l:lY a (I;1on-climbing type .0
<br />fence or wall. All fence openings or points of entry into the poo
<br />area enclosure shall be equipped with gates. The fence and gates
<br />shall be at least five (5) feet in height and shall be constructe
<br />of materials approved bythe;Build~ng Inspector. All gatessha 11
<br />be equipped with self-closing,:a!:id:self-lliltching devices placed on
<br />the top of the gate or otherwise;in.C!c~ssible to small children.
<br />All fence posts shall be dec~y or corrosion resistant and shall be
