<br />" <br /> <br />-rage 'I. <br />, <br /> <br />1l-370-PJ]BLIC HEARIN:G <br /> <br />(A) The Planning Commission reoommendation of the preliminary plan with any amendments <br />or oo~ditions attached thereto shall be plaoed on the agenda of the next regular meet- <br />ing of the Village Counailto set a date for a public hearing which shall take place no <br />later than 45 days after receipt of the applications from the Planning Commisslono <br /> <br />(B) The publio h~aring shall be held after notice of the time and place of such <br />hearings has been published in the offiaial newspaper at least ten (10) days before <br />the hearing and the Village Council shall have also caused a notioe to be mailed to each <br />of the owners of property within 200 feet of the property for whioh the Plarmed <br />Residential Development is requested, such notices to be mailed at least 10 days before <br />the hearing, aocording to the abstractor's oertifioate provided by the pe'titionero <br /> <br />(C) Mter the Public Hearing the Village Council shall approve, approve with condi,- <br />t:ions or modj,ficat:lons or deny the applioation. <br /> <br />(D) If'the application for a Pre]jm.1nary plan for Planned ResidenM,al Developm~mt :t.s <br />de1flied, th~ applicant :may at his elecltion, abandon the appH.cation or may reapply <br />with a new plan. <br /> <br />11:180-PLANN.~OMM.ISSIQN_FlNA.L PlJlN REVIEW AND CONSIDERATlQ!i <br /> <br />(A) No final plan shall be recei v8d or considered unless it is based on an approved <br />Preliminary PIano <br /> <br />(B) The Planning Commission shall revieW' the final plan at its first regularly <br />sche:duled meeting which occurs 14 days. after filing the application for final approval. <br /> <br />(0) The final plan for Plumed Residential Development shall be in substantial com- <br />pliance with the preliminary plano <br /> <br />(D) Substantial compliance shall mean any plan tha.ti <br /> <br />1 - Has not increased its residential densityo <br /> <br />2 - Has not enlarged its non-residential floor area. <br /> <br />3 - Has not decreased the area. of the Open Space or changed <br />the design of it so as to inhibit its original intent <br />and design. <br /> <br />4 - Has complied with the conqitions or amendments placed <br />on the pr~liminary plan by the Village Council. <br /> <br />(E) The Pl.anning Comm.:1.ss1on shall determine whether the final plat is in compliance <br />with the pro'visions for' f::Ding a plat according to the Platting Ordinance IICfl and <br />shall H.st all variations or modifications from Ordinance #107 in acoordance with <br />Sections 11-350 K and Section 11-350 Po <br /> <br />(F) The Planning Commission shall indicate by recommendation to the Village Council <br />that; the final plan for Planned Residential De'Velopment. 1s in substantial compliance <br />w1'th the preliminary plan and shall add any further oonditions it deems necessary 'to <br />protect the publio health, safety, morals, and general welfare 0 Any final plan <br />deetmed not to be in substantial oompliance with the preliminary plan, or in complianoe <br />
