<br />(a) The front Ylud set-back in any industrial district ',I
<br />shall be forty (40) feet. On corner lots, the set-back
<br />from nU street lines shall be forty (40) feet. Where
<br />anindi.Jstrial distriet is separated from a residential 'I
<br />district by a street:, the se,t-back from the street in ~,
<br />industrial distdct shall be not le~s than 100 feet.
<br />(b) The side yard set-back in any industrial district shall
<br />be not less than fifteen (15) feet.
<br />(c) The industrial district side yard adjacent to a resi-
<br />dential boundary line shall llrovide for a landscaped
<br />strip 60 feet in width along such boundary line. A 1',0
<br />pOl'tion of this landscaped strip shall be planted to
<br />provide a screen. The Village Council may require I
<br />additional side yard width in these caSes. When such '
<br />additional width is required, such additonal width _I
<br />shall not exeeed 100 feet and parking in this area ,
<br />will be permitted.
<br />(d) The l'ear yard set-back in all industrial districts shall
<br />be a lllinimum of twenty (20) feet which may be used
<br />for parking. If the rear yard of an industrial district
<br />abutts on or is across an alley from a residential dis-
<br />trict, the provisions of paragraph c of this section
<br />shall apply.
<br />(e) It j>hall be the policy or the Council to issue l?el'mits
<br />for the construction of buildings in the industrIal dis-
<br />tricts on the basis of the actual widths and areas re-
<br />quired by the builder to allow room for such building
<br />aod .its use to conform with this ordinance. Each pro_
<br />posal may be referred to the Planning Commission
<br />for study and recommendation,
<br />(f) No building constructed in any industdal district
<br />shall be mOre than forty (40) feet in heig'ht, 1
<br />(g) In light industdal districts, the f1001'-area-ratio shall ]
<br />be a maximum of 0.3 for .a one-story building and
<br />0,4 for a two-story building. In heavy industrial dis-
<br />tricts, the ratio shall be 0.4 for one-story and 0.6 for
<br />two-story buildings,
<br />(h) In any industrial district, the fl'ont yard and/or any
<br />side yard bordering upon a street shall be landscaped
<br />and shall not be used for parkin~.
<br />(i) The application, for a building pel'mil: in industdal
<br />districts shall be accompanied by a cOlnplete plot plan
<br />Showing the proposed building or buildings and also
<br />the proposed USe of the balance of the property. The
<br />plan shall show waste disposal, water supply, drail1-
<br />age, ingress and eg'l'eSS, landscaping', screening and
<br />other pet'tinent data. Distances to surrounding build-
<br />ings must also be shown on the plot plan. The Coun-
<br />(,il may submit these plans to the Planning Commis-
<br />sion for consideration and recommendation. In any
<br />event, no building permit shall be issued for any con-
<br />struction in a business district until authorized by a
<br />majority vote of the Council. '

<br />SPECIAL USES, PERMITS, VARIANCES
<br />CLASSIFICATION

<br />Special uses as sh?wn i~ specified ,dis~ricts of this ~rdm-
<br />ance may be permItted 1n those d1Stl'lCtS by the Vlllage
<br />Council where such uses are deemed essential or desirable
<br />to the public convenience, welfare, and are in harmony with
<br />the various elements or objectives of the master plan, and
<br />if their location, plan and character of the development are
<br />first considered by the Planning Commission following the
<br />procedure set forth in this ordinance. In the exercise of its
<br />approval, the Council may impose such conditions l'egard~
<br />in~ the location, character and other features of the pw.
<br />posed building, structure or Use as it m~y dee,m advisable
<br />in the furtherance of the purposes of thl5 ordmance.
<br />PROCEDURE. , ,
<br />Applications for sp,eclal use pel'llllts and varIances shall lle
<br />accepted by the Vll1a~eMalJager upon. the payment of a
<br />$25.00 fee by the appl1cant. All aJlphcatlO~s~hall be ref~r-
<br />red by the Manager to the, Planmng' Con,lmlsslOn for ~'onsld-
<br />eration and recommendatIOn to the Village Council. The
<br />Planning Commission may hold a public hearing following
<br />publication as prescribed in Section 1:'1-120 of this ordinance.
<br />'The Commssion shall report to the Council within forty
<br />(40) days after receiving ~he. application at a reg~lar meet-
<br />ing, The Councll shall, wlthm 45 days after recelpt of the
<br />application by the Planning Commission and with or with-
<br />out a recommendation from the Planning Commission,
<br />consider the application at a public hearing following pub-
<br />lication as prescribed in 13-120 of this ordinance, The
<br />Council may grant 01' deny application for spec.iaJ use per-
<br />mit by a majority vote of it:s membership.
<br />VARIANCE
<br />Where there are practieal difficulties 01' ullusual hardships
<br />in the way of carrying out the stl'ict letter of the provis-
<br />ion:s of this ordinance, the Council shall have the power,
<br />in a specific case to permit a variance from the provis-
<br />ions of this ordinance. (See definition of variance).
<br />COUNCIL MAY STIPULATE
<br />In g-ranting' a l'equ.est fOl' a special use permit or II Var-
<br />iance, the Council may stipulate any conditions considered
<br />necessary to protect the public health, :safety '01' welf..re.
<br />APPLICATION FORMS, PROPERTY DESCRIPTIONS
<br />Applications for special Use permits or variances shall be
<br />made On forms furnished by the Village, All applications 12
<br />shall include a legal des<:ription of the property involved
<br />and also a description to include all property owned by the
<br />applicant wh.ich is contiguous thereto.
<br />TIME LIMIT
<br />A speci~l use lJermit or a val'iance permit, when not used,
<br />sho.!! eJCpire after 180 days after date of issuance unless
<br />written application for renewal 01' time extension is receiv-
<br />ed and gl'anted by the Village ,Council priolo to the expira-
<br />tion date.
