b, Charges initiated with a view toward removal or discharge shall be investigated by the <br /> department on behalf of the Commission and the opportunity to be heard before the <br /> Commission. Its findings and decision shall be certified in writing to the City Manager <br /> for immediate enforcement A copy of the findings and decision, any order of <br /> disciplinary action, and a notice of right of appeal shall be sent to the employee within <br /> three days after completion of the hearing. <br /> c,. An employee found guilty after a Commission hearing of inefficiency, breach of duty, <br /> misconduct, or violation of departmental or Commission rules or regulations may be <br /> reprimanded, suspended, demoted or terminated. <br /> If the Commission finds the employee not guilty, and the employee was suspended <br /> pending investigation, the employee shall be immediately restored to duty with all back <br /> pay due for the period of suspension. <br /> An employee may be discharged or reduced in grade if their application for employment <br /> or promotion contains misrepresentations or deceptions, or if the applicant does not meet <br /> the minimum requirements of the position for which they applied. <br /> e. Nothing in the preceding paragraphs, including Section 8 (b) above, shall be construed to <br /> require a Commission hearing for disciplinary action less severe than 60 days' suspension <br /> without pay, or if the employee waives a hearing. <br /> Section 10. Resignation. <br /> a. A resignation in good standing shall be made by giving the Director of Public Safety a <br /> written notice not less than 14 days in advance of resignation. Failure to give such notice <br /> may be considered sufficient reason for rejecting any further employment applications <br /> from such employee. <br /> b. Employees who are absent without authority or who fail to notify their superior officer of <br /> the reason for their absence and the time when they will return on duty, shall be <br /> considered to have resigned without notice, after three consecutive work days. <br /> c. The Commission shall be notified in writing of all resignations. <br /> Section 11. Retirement. <br /> a. Compulsory retirement of any sworn officer shall be required when the sworn officer <br /> reaches the age of 70 years. No waiver of this requirement shall be permitted. <br /> b. Retirement shall also be required when an employee, for reasons other than service- <br /> connected injuries, is unable to meet minimum proficiency or physical standards for job <br /> classification as determined by a medical or psychological examination. <br /> 4 <br />
