<br />t. -~ <br />to further guarantee that the terms of said special use permit shall remain a <br />permanent part of the records of' the Village of New Brighton the Village Council <br />hereby adopts the terms of said special use permit by ordinance. <br />Section 2. Conditions of Special Use Permit. <br /> <br />1. This permit shall be perpetual. <br /> <br />2. That the land use plat attached hereto and forming a. part <br />hereof shall permanently designate the development of the <br />above described tract of land by the United Theological Seminary. <br />Said plat shall be approved by the Village Council a.nd shall <br />carry thereon the signatures of the Mayor and Village Clerk and <br />the President and Treasurer of the United Theological Seminary. <br />Three copies of this permit and land use plat sballbecom.e <br />a permanent part of the Village records and shall be retained on <br />file with the Village Clerk. <br /> <br />(a) Said land use plat shall deSignate the areas of the <br />above described tract that shall be used for single family <br />residences, educational buildings, student housing, and <br />retreat area. <br /> <br />(b) The following terms are defined: <br /> <br />1. Single family residences: A single family <br />residence is a dwelling constructed for the use <br />of one family containing not less than thirteen <br />hundred square feet plus an attached garage and <br />must conform to the provisions of Or41nance No. <br />56 as amended. No single family residence within <br />the area designated to be used for single family <br />residences shall be closer than thirty (30) feet <br />from the nearest point on neighboring single family <br />residences within the afore described zone. <br /> <br />2. Educa tional Buildings: A structure not higher <br />than two stories containing class room facilities. <br />For the purpose of this permit a chapel ~ be placed <br />in the area designated for educational buildings and shall <br />not be restricted to two stories in height. <br /> <br />3. Student housing: Dorm1 tories or one bedroom <br />apartment buildings not over two storlles in height <br />for the use of persons registered as bona fide students <br />of the seminary. <br /> <br />4. Retreat Area: An area devoted to the construction <br />of facilities conducive to study and mediation by <br />United Theological Seminary personnel. <br /> <br />5j The area designated -future housing" on the <br />attached plat map shall be restricted to future <br />construction of student hOUSing, as defined above, <br />and to single family residences as defined above. <br /> <br />(c) No building of any kind or type, other than single family <br />residences as defined above, shall be constructed or maintained <br />within two hundred fifteen feet (215) of any point on the boundary <br />of the present plat of Lake Forest. No road or drive, other than <br />an extension of Driftwood Lane, shall be constructed or maintained <br />wi thin one hundred forty feet (140) of an,v 1:l0int on the bounda.rv <br />
