The City has been advised to have the guidelines in <br /> place before starting to interview developers. <br /> Doffing reported she has spoken with several business people in the area and they are <br /> considering relocating to Northwest Quadrant. <br /> Midwest Asphalt <br /> The City is currently under a confidentiality agreement due to mediation. The City has received <br /> a proposal from MWA that is not acceptable. The main issues being discussed are the purchase <br /> price and the timing of the move. The Supreme Court ruling has not changed how mediation is <br /> proceeding. The City is expecting to receive through mediation new information from the <br /> company that will give us an idea of how much it is worth. <br /> MWA has received a copy of the Phase I contamination report. The MPCA does not require <br /> companies to clean up their own land as long as the company stays on the site. The current <br /> regulations put the burden on the developer. The City has had success working with other land <br /> owners to take responsibility for the cleanup of their sites. <br /> Kaufhold asked if there were any higher level of contaminants coming from the Midwest <br /> operations. Black replied that most of the contamination was generated by previous users and <br /> has traveled due to the shallow groundwater. Flahave inquired about the groundwater depth. <br /> Black responded that it is roughly six feet below ground, but shallower in some areas and deeper <br /> in others. Several commission members voiced concern over the possible contaminates on the <br /> site. Black reiterated that the City plans to do an aggressive cleanup of the site, removing all soil <br /> down to the groundwater level and deeper. The site will be cleaned up; the question is who will <br /> pay for it. <br /> Delaune wondered if the City has or would put together best case/worst case scenarios. Black <br /> responded that with so many variables that it would be difficult to put anything together, but that <br /> they were considering all variables. <br /> Rail Spur <br /> Fernelius reported that the City has been working with the USF Dugan, a trucking firm, to <br /> purchase the land and to add the wye and team track. But now the trucking firm is to be sold, <br /> therefore decision makers will likely change and this project will have to be reconsidered in light <br /> of different needs. The City is working with engineer Dave McKenzie of SEH, on how to <br /> properly apply the funds when they are received. Completion is anticipated next year. <br /> Kaufhold inquired about the use of the track as part of the light rail system. Fernelius responded <br /> that a light rail system is not a present possibility; however the City would like to keep the track <br /> to connect the Northstar line to the west and in the future connect to the St. Paul or Minneapolis. <br /> Post Office <br /> Black reported that the City has had no direct contact with the Postal Service in the last few <br /> weeks. A formal site decision is scheduled within 30 days. Environmental testing of the land <br /> proposed to swap with Bell Pole is being conducted this month. Agreements in principle have <br /> been reached with Bell regarding the land to be swapped and payment of associated costs. It <br /> appears building would start next spring. <br />
