c. That the establishment of the special use will not impede the normal and <br /> orderly development and improvement of the surrounding property for uses <br /> permitted in the district. <br /> d. That adequate utilities, access roads, drainage and/or necessary facilities have <br /> been or are being provided. <br /> e. That the special use shall, in all other respects, conform to the applicable <br /> regulations of the district in which it located. <br /> Staff believes that the proposed site plan will not be injurious to the use and enjoyment of other properties <br /> in the area and that it does not impede the development and improvement of other properties. The site <br /> conforms to all other applicable regulations of the MX zone. <br /> RECOMMENDATION <br /> Staff Recommendation <br /> Motion to waive the reading and approve SP05-11 AND LP 05-07,SUBJECT TO THE FOLLOWING <br /> CONDITIONS: <br /> 1. Compliance with SP04-01 and LP03-08 and all elevation, landscape, and lighting plans <br /> attached. <br /> 2. Compliance with the submitted site plan received July 27,2005. <br /> 3. The applicant should re-submit grading and drainage plans to be approved by the City <br /> Engineer. <br /> 4. A special use permit is applied for to consider signage through the comprehensive sign plan <br /> process. <br /> 5. The storage of any packaging, garbage or recycling material shall not be stored outside of the <br /> dumpster enclosure area as depicted on the site plan. <br /> 6. Garden Sales Area items shall be stored only in the"garden center"area as depicted on the <br /> July 27,2005 amended site plan. <br /> 7. Items within garden sales area shall not be stacked above the 6 foot masonry wall or fenced <br /> area nor be visible from Old Highway 8 NW. <br /> 8. Outdoor"Garden Sales area"can include shrubs, fountains,bagged materials such as soils <br /> and manure,mulches,trees, and small utility sheds located against wall which shall not <br /> exceed 120 sq. ft. and power equipment. <br /> 9. The Garden Sales area shall be wholly contained by a fence; arborvitae shall be densely <br /> planted for screening of this area. <br /> 10. Trees over 6 feet may extend above the screening. <br /> 11.
