STAFF COMMENTS: AUGUST 2005 PROPOSED AMENDMENT <br /> Outdoor Garden Sales Area <br /> Regarding the expansion in size of the outdoor"garden sales area"on the west side of the building: <br /> • The applicant is urged to comply with all conditions of approval for screening and <br /> appropriate materials for sale within the Garden Center; <br /> • Significant pavement is proposed to be replaced by additional green space. If the site plan <br /> then has reduced stormwater run-off calculations,then a new drainage plan should be <br /> submitted with pond and infiltration configurations for Staff approval. <br /> Special care should be exercised to ensure that the view from all rights-of-way are aesthetic and in the <br /> intent of redevelopment goals. The applicant should submit detailed plans on the outdoor sales area <br /> including,but not limited to seasonal considerations. <br /> Parking and Drive Aisle Configuration <br /> For parking calculations,the use requires 153 stalls on site. The site plan dated 7-27-05 shows 158 stalls <br /> (includes 6 ADA stalls) for a surplus of 5 parking stalls. In the applicant's proposal,there are 19 <br /> "overflow"and 6 "short term"parking stalls. <br /> City Redevelopment Efforts <br /> Within the context of redeveloping a marquee site in the City, and the strict design guidelines of the MX <br /> district,the applicant has agreed to: <br /> • rotate outdoor sales items on a seasonal basis; <br /> • not store items above the fence; and, <br /> • maintain an orderly and clean sales area. <br /> The MX district was created to facilitate the construction of high-quality materials and aesthetics. <br /> Besides on-sale trees, anything displayed in the garden sales area above the 6 foot fenced in portion of the <br /> garden sales area should not be allowed. <br /> SPECIAL USE PERMIT <br /> Within the context of the project, amending an approved site plan requires a special use permit <br /> application. <br /> As specified in Section 8-130 of the New Brighton Zoning Ordinance,no special use shall be approved <br /> unless the City Council such shall find: <br /> a. That the establishment,maintenance, or operations of the special use will not <br /> be detrimental to or endanger the public health, safety,morals, comfort of the <br /> general public. <br /> b.
