Approved <br /> 7 Ayes, 0 Nays,MOTION CARRIED. <br /> Motion by O'Brien, Second by Zisla to WAIVE THE READING AND ADOPT THE ATTACHED <br /> RESOLUTION RECOMMENDING APPROVAL OF SP2006-006, subject to the following <br /> conditions: <br /> 1. The proper business license is obtained with the City Sanitarian. <br /> 2. The applicants submit the required Special Use Permit processing fee of$200. <br /> 7 Ayes, 0 Nays. MOTION APPROVED. <br /> Public Hearing: PL2006-001, VA2006-002 Preliminary Plat and Right-of-Way <br /> Vacation for Property at Northwest Corner of 5th Avenue NW& 1st Street NW <br /> Zisla recused himself from this public meeting discussion. <br /> The City of New Brighton is requesting a preliminary plat, which ultimately will include <br /> a right-of-way vacation, for property located at the northwest corner of 5th Avenue NW <br /> and 1st Street NW. The City currently owns the property located to the east of the <br /> existing, undeveloped right-of-way known as 6th Avenue NW. Bell Pole & Lumber owns <br /> the property to the west of that right-of-way. The preliminary plat will create three lots <br /> on one block to be known as BRIGHTON CORPORATE PARK VII. The right-of-way <br /> vacation is needed in order to re-plat the property and facilitate redevelopment. <br /> Following approval of the preliminary/final plat and right-of-way vacation, the City will <br /> continue its pursuit of a land swap will Bell Pole & Lumber. The land swap will result in <br /> Bell Pole & Lumber acquiring proposed Lot 3 with the City acquiring all of proposed Lot <br /> 1 and Lot 2. Currently, Bell Pole & Lumber occupies all of the land to the west of the <br /> dedicated right-of-way proposed for vacation. Following the land swap, all of Bell's <br /> operations will move to proposed Lot 3. This allows the City to sell proposed Lot 2 to <br /> Ryan Companies for future construction of the carrier annex, in conjunction with <br /> relocation of the post office from the Northwest Quadrant. It is anticipated that proposed <br /> Lot 1 would be sold to Dalco Companies to the north. <br /> Baker inquired if Bell Pole would continue operating on the property. Gundlach replied <br /> that they would move their pole storage to lot three, the southern lot. O'Keefe inquired if <br /> Bell Pole is storing their poles on the right of way by permit. Gundlach replied that she <br /> did not know the answer to that question. O'Keefe inquired if there is any environmental <br /> protection of anything being left behind when the poles are removed and we vacate the <br /> right of way.
