Approved
located at 2023 Old Highway 8 NW and is proposing, as part of the plat, to combine it
with existing property to be used for future surface parking, if needed.
The preliminary and final plat will run together whereby three properties will be
combined on one lot and one block to be known as the Niedernhoefer Addition. Lastly,
the plat as proposed includes road property that will be acquired as part of a right-of-way
vacation of Mound Avenue. This would be a partial Vacation, considered as a separate
item, whereby the City would retain the ability to keep utilities in this location but would
vacate the right-of-way for public purpose. Procedurally, approval of this proposal would
include the condition that the right-of-way vacation is approved.
O'Brien inquired to why staff is requesting a one year maximum on the removal of the
house and not the two years that was requested. Gundlach replied that under similar
circumstances the City typically requires a one year removal and a letter of credit, but the
Commission could suggest a different time line. O'Keefe asked if it applies to all the
structures on the lot. Gundlach replied that it does apply all the structures on the lot.
Zisla inquired to why this property is subjected to a park dedication fee since it is a
redevelopment. He added that he would like to know if there is a formula that will decide
how much the cash amount would be versus a 10 percent land dedication, and what are
the criteria for the formula that the Council will use to determine the amounts.
Gundlach replied that the park dedication ordinance states that it does apply to re-
divisions that facilitate a redevelopment. She added that a formula in relation to a cash
amount is not in the ordinance; however that ordinance does state that the Council has the
discretion to increase or decrease the dedication depending upon its intended use. If the
Council decides that this development will have little impact on our park system, then
they could reduce the dedication.
Mann stated that she understands that no new employees are being added and citizens
would not be going to enjoy a park in that general area, the Council can keep those items
in mind when considering the development's park dedication fee. Gundlach stated that is
how she understands the ordinance; however there is not a specific formula to be used.
Zisla inquired if there is a formal process where by the amount can be reduced.
Gundlach replied that this is the first time the park dedication fee will be applied to a
commercial development, so the Council will need to decide what sort of process they
would like to implement.
Zisla asked if Commissioner Mann's statement is true that they would not be adding any
employees. Gundlach replied that it is her understanding that they will not be adding
employees to the addition. Norm Wells, architect for this development, stated that
Cheetah Precision would not be adding any employees. This addition is to attach the two
existing buildings so, the current employees do not have to traverse outside during
inclimate weather, and to increase the amount of work space. The manufacturing area
will be in the northern building, the new building will contain new offices and warehouse
I:ACOMMTSSTONS\PLANNING\Minutcs\2007\02-20-2007.docPage 2 of 7
