<br />person, except wholesalers or manufacturers to the extent authorized under <br /> <br /> <br />state license shall directly or indirect~ deal in, sell or keep for sale <br /> <br /> <br />any intoxicating liquor without first having received a license to do so <br /> <br /> <br />as provided in this ordinance. Licenses shall be of three kinds: "On-sale", <br /> <br /> <br />"Off-sale", and club licenses. <br /> <br /> <br />Subdivision 2. lion_sale" licenses for the sale of intoxicating <br /> <br /> <br />liquor shall be issued only to clubs as defined in Section 1. "On-sale II <br /> <br /> <br />licenses for the sale of non-intoxicating malt liquors shall be granted only <br /> <br /> <br />to clubs, beer stores, drug stores, restaurants and hotels where food is <br /> <br /> <br />prepared and served for consumption on the premises. <br /> <br />Subdivision 3. "Off-sale" licenses for the sale of intoxicating <br /> <br /> <br />liquor, with the exception of the municipal liquor dispensary, shall not be <br /> <br /> <br />issued by the Village Council. "Off_sale" licenses for the sale of non- <br /> <br /> <br />intoxicating malt liquors shall permit the sale of beer at retail or at <br /> <br /> <br />wholesale in the original package for consumption off the premises only. <br /> <br /> <br />SECTION 9. Applications for License. Every application for a <br /> <br /> <br />license to sell liquor or non-intoxicating malt liquors shall be verified <br /> <br /> <br />and filed with the Village Clerk. It shall state the name of the applicant, <br /> <br /> <br />his age, representations as to his character, with references as may be <br /> <br /> <br />required, his citizenship, whether the application is for a club license, <br /> <br /> <br />or "on_sale" license for the sale of non-intoxicating malt liquors, or an <br /> <br /> <br />"off_sale" license for the sale of non-intoxioating malt liquors, whether the <br /> <br /> <br />applicant is the owner and operator of the business, how long he or she has <br /> <br /> <br />been in that business at that location, and such other information as the <br /> <br /> <br />Council may require from time to time. No person shall make a false statement <br /> <br /> <br />in an application. <br /> <br /> <br />Subdivision 2. Each application for a club license shall be <br /> <br /> <br />accompanied by a surety bond, liability insurance policy, or in lieu thereof" <br /> <br />cash or United States government bonds of equivalent market value as provided <br /> <br /> <br />in Minnesota Statutes 1945, Section 340.12 except that the liability insurance <br /> <br /> <br />policy provided for in Laws 1945, Chapter 313 and embodied in the fourth <br /> <br /> <br />paragraph of Section )40.12 shall not be acceptable.
