PLANNING REPORT <br /> DATE: May 17, 2005 <br /> CASE: SP05-11 & LP05-07 <br /> SUBJECT: Modify an Approved Special Use Permit(SP04-01 & LP03-08) <br /> APPLICANT: Mr. Mark Beisswenger <br /> REQUEST <br /> To consider an amendment to the approved site plan and special use permit for the new Beisswenger's Do <br /> It Best hardware store. <br /> Mr. Beisswenger approached Staff about altering the types of items for sale at in the Outdoor Garden <br /> Sales Area. Specifically,he wishes to offer used gasoline engines for sale. The for-sale items are part of <br /> the special use permit and therefore the proposal to sell used engines requires an amendment to the <br /> special use permit and a public hearing. <br /> FINDINGS <br /> • Section 8-110, Special Use Permit <br /> • Council Agenda Report 04-015 (approved January 13, 2004) <br /> The only change proposed is for an expansion in size of the outdoor"garden sales area"on the west side <br /> of the building. Since the Council approved the special use permit in 2004,Mr. Beisswenger has a slight <br /> change in business plans and now wishes to include used power equipment/gasoline engines for sale in <br /> the garden sales area. <br /> The pond has changed shape and the number of"proof of parking" spaces has increased. However,the <br /> remaining components of the site plan are not proposed to be changed and therefore the following review <br /> is for the outdoor garden center only. The original Council Report(04-015)is attached. <br /> Outdoor Garden Sales Area <br /> 2004 Approved Plan: Plans indicate a fence for screening around the entire outdoor garden sales area <br /> and greenhouse facility. The property is located at a major intersection and at a gateway to the city. <br /> Special standards should be developed to ensure that the view from all rights-of-way are aesthetic and in <br /> the intent of redevelopment goals. The applicant should submit detailed plans on the outdoor sales area <br /> including,but not limited to seasonal considerations. <br /> On January 13,2004,the New Brighton City Council passed a resolution with the following condition: <br /> 4. Outdoor"Garden Sales area" can include shrubs, fountains, bagged materials such as <br /> soils and manure, mulches, trees, and small utility sheds located against wall which shall <br /> not exceed 120 sq. ft. <br /> The applicant wishes to add"used gasoline engines"to the list of items in the garden sales area. <br /> I:\COMMISSIONS\PLANNING\Reports\2005\05-17-05\SP05-11_LP05-07_BEISSWENGER AMENDED SITE PLAN.doc 1 <br />
