PLANNING REPORT DATE: May 17, 2005 CASE: SP05-11 & LP05-07 SUBJECT: Modify an Approved Special Use Permit(SP04-01 & LP03-08) APPLICANT: Mr. Mark Beisswenger REQUEST To consider an amendment to the approved site plan and special use permit for the new Beisswenger's Do It Best hardware store. Mr. Beisswenger approached Staff about altering the types of items for sale at in the Outdoor Garden Sales Area. Specifically,he wishes to offer used gasoline engines for sale. The for-sale items are part of the special use permit and therefore the proposal to sell used engines requires an amendment to the special use permit and a public hearing. FINDINGS • Section 8-110, Special Use Permit • Council Agenda Report 04-015 (approved January 13, 2004) The only change proposed is for an expansion in size of the outdoor"garden sales area"on the west side of the building. Since the Council approved the special use permit in 2004,Mr. Beisswenger has a slight change in business plans and now wishes to include used power equipment/gasoline engines for sale in the garden sales area. The pond has changed shape and the number of"proof of parking" spaces has increased. However,the remaining components of the site plan are not proposed to be changed and therefore the following review is for the outdoor garden center only. The original Council Report(04-015)is attached. Outdoor Garden Sales Area 2004 Approved Plan: Plans indicate a fence for screening around the entire outdoor garden sales area and greenhouse facility. The property is located at a major intersection and at a gateway to the city. Special standards should be developed to ensure that the view from all rights-of-way are aesthetic and in the intent of redevelopment goals. The applicant should submit detailed plans on the outdoor sales area including,but not limited to seasonal considerations. On January 13,2004,the New Brighton City Council passed a resolution with the following condition: 4. Outdoor"Garden Sales area" can include shrubs, fountains, bagged materials such as soils and manure, mulches, trees, and small utility sheds located against wall which shall not exceed 120 sq. ft.
