Other Considerations: None <br /> STAFF COMMENTS <br /> Proposed Land Use:Food Shelf <br /> The property is zoned R-1,Single Family Residential. "Food Shelf'is neither listed as a <br /> permitted use nor listed as a special use in the zoning district. The Council may consider other <br /> uses not listed and the City is required to hold a public hearing with published and mailed <br /> notification of the proposal. <br /> The Ralph Reeder Food Shelf serves clients during the week on an appointment only basis. (see <br /> attached sheet submitted by applicant). There is no commercial activity or transactions involved <br /> with the operation and Staff fords the use compatible with community facilities associated with <br /> elementary schools and believes the effects to the surrounding neighborhood to be minimal. <br /> At time of writing,Staff received one phone call from a resident who did not agree that the site <br /> should have a food shelf. They plan to attend the public hearing on July 19,2005. <br /> Special Use Permit <br /> As specified in Section 8-130 of the New Brighton Zoning Ordinance,no special use shall be <br /> recommended by the Planning Commission unless such shall find: <br /> a. That the establishment,maintenance,or operations of the special use will not be <br /> detrimental to or endanger the public health,safety,morals,comfort of the general <br /> public. <br /> b. That the special use will not be injurious to the use and enjoyment of other property <br /> in the immediate vicinity for the purposes already permitted,nor substantially <br /> diminish and impair property values within the neighborhood. <br /> c. That the establishment of the special use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the <br /> district. <br /> d. That adequate utilities,access roads,drainage and/or necessary facilities have been or <br /> are being provided. <br /> e.
