Special Use Standards <br /> As specified in Section 8-130 of the New Brighton Zoning Ordinance,no special use shall be <br /> recommended by the Planning Commission unless such shall find: <br /> a. That the establishment, maintenance,or operations of the special use will not be detrimental <br /> to or endanger the public health, safety, morals,comfort of the general public. <br /> b. That the special use will not be injurious to the use and enjoyment of other property in the <br /> immediate vicinity for the purposes already permitted,nor substantially diminish and impair <br /> property values within the neighborhood. <br /> c. That the establishment of the special use will not impede the normal and orderly development <br /> and improvement of the surrounding property for uses permitted in the district. <br /> d. That adequate utilities,access roads,drainage and/or necessary facilities have been or are <br /> being provided. <br /> e. That the special use shall,in all other respects,conform to the applicable regulations of the <br /> district in which it located. <br /> STAFF NOTES <br /> The sale event is proposed to run during the hours of 8:00 AM to 4:30 PM in the fall and spring each <br /> year. The CU Companies-owned lots has 332 parking stalls available for sales staff, buyers,and sale <br /> items. The applicants are proposing to hold events that will encompass between 125 and 175 vehicles. <br /> The applicant has conducted several such events in other communities and held a successful event in New <br /> Brighton on May 21, 2005. <br /> The Director of Public Safety reviewed the May 2005 event and noted that traffic and pedestrian <br /> circulation was acceptable. <br /> The above criteria for a Special Use Permit are met. <br /> RECOMMENDATION <br /> Motion to waive the reading and adopt the attached resolution RECOMMENDING APPROVAL of <br /> SP05-13 for the Special Use Permit, subject to the following conditions: <br /> 1. The applicant shall be allowed to hold two events per year <br /> 2. Vehicle sales shall be one day in duration and each event shall end at 4:30 PM. <br /> 3. For Sale vehicles shall be off site by no later than 6:30 PM on the day of the sale. <br /> 4.
