Page 2 <br /> STAFF COMMENTS <br /> Variance <br /> A variance may be granted from the literal provisions of the Zoning Ordinance in instances where <br /> strict enforcement would cause an undue hardship because of unique circumstances and when it is <br /> demonstrated that such a variance would be consistent with the spirit and intent of the ordinance. <br /> Sec.8-210 Variance Standards. <br /> The lot is 60 feet wide by 402 feet deep; the applicant wishes to demolish the existing one-story <br /> structure and construct a new home on the site. <br /> Throughout the history of New Brighton,lots of differing configurations were platted. In the R-1, <br /> Single Family Residential Zone,the standard lot is 75 feet wide. The subject site was platted as a 60 <br /> feet wide parcel, which is 15 feet short of standard. <br /> The City would need to approve a 15-foot lot width variance for the site plan to be approved and a <br /> building permit issued. <br /> Assuming all yard setbacks are met,the"buildable"area of the lot is 18,350 sq. ft. There are many <br /> single family dwelling designs the applicant could pursue to redevelop this lot that will not disrupt the <br /> surrounding developed parcels. <br /> Where there are practical difficulties or unusual hardships in the way of carrying out the strict letter of <br /> the provisions of the Zoning Code,the City Council shall have the power, in a specific case,to permit <br /> a variance from the provisions of the Zoning Code. <br /> The Planning Commission shall hold a public hearing and make a recommendation to the City <br /> Council. The crucial points of the variance are: <br /> (1)Undue hardship. <br /> (2)Unique circumstances. <br /> (3)Applying to property. <br /> (4)Conformance with the comprehensive plan. <br /> (5)Variance shall not be detrimental to adjacent property or to the public as a whole. <br /> The proposed expansion conforms with the Comprehensive Plan and would not be detrimental to <br /> adjacent properties or the public. <br /> The Planning Commission should recommend approval for a 15 foot lot width variance for the <br /> property at 1795 Long Lake Road. <br /> STAFF RECOMMENDATION <br /> Waive the reading and adopt the attached resolution recommending approval to the City Council. <br /> 1C <br /> Patrick Boylan, City Plann; <br /> I:\COMMISSIONS\PLANNING\Reports\2005\07-19-05\VN05-02_1795 Long Lake Rd.doc <br />
