PLANNING REPORT <br /> DATE: August 16,2005 <br /> SUBJECT: Code Amendment Proposal: Stormwater Control for Construction Sites <br /> CASE: ZA05-10 <br /> BACKGROUND <br /> The Environmental Protection Agency(EPA)estimates that over 40%of the nation's waterbodies <br /> are polluted. The EPA mandates that municipalities help prevent pollution and consequently,the <br /> City of New Brighton is charged with developing a Storm Water Pollution Prevention Plan <br /> (SWPPP)for water that enters the City's stormwater system. <br /> The City is responsible for maintaining a National Pollution Discharge Elimination Systems <br /> (NPDES)permit. One NPDES Permit requirement is for the City to develop a Stormwater <br /> Pollution Prevention Plan,which has several"best management practices,"to control pollution. <br /> NPDES—Best Management Practice for Construction Site Permitting(BMP-11) <br /> The City must develop, implement, and enforce a program to reduce pollutants in any storm <br /> water run off from construction activities within the City that result in land disturbances of <br /> greater than or equal to one acre. The City,by strengthening the stormwater run off controls <br /> within the City Code, is implementing a Best Management Practice(BMP). This includes: <br /> • An ordinance to require erosion and sediment controls; <br /> • Requirements for construction site operators to implement appropriate erosion and <br /> sediment control practices; <br /> • Requirements to control waste on site, such as discarded building materials, concrete <br /> truck washout, chemicals,litter, and sanitary waste at the construction site that may <br /> cause adverse impacts to water quality; <br /> • Site plan review procedures that incorporate consideration of potential water quality <br /> impacts; <br /> • Procedures for receipt and consideration of reports of non-compliance or other <br /> information on construction related issues submitted by the public; and, <br /> • Procedures for site inspection and enforcement of control measures. <br /> The Engineering Department has crafted code amendment text,which if adopted,will assist the <br /> City in fulfilling the obligations to the EPA for the City's NPDES Permit.
