Underlined text indicates added text, strikethrough indicates text removal. <br /> PROPOSED CODE AMENDMENT <br /> Sec. 7-99.Erosion Control. <br /> The applicant for a building or other construction related permit shall take all reasonable steps to <br /> prevent or minimize damage to private or public property caused by erosion from the construction <br /> site.When erosion occurs despite such efforts,the permit holder shall promptly act to clean up <br /> and restore the damaged property to its original condition. (Ord.No. 561, 12-8-87; Code of 1988; <br /> Code of 2001) <br /> Erosion control and prevention measures for construction sites shall meet standards from State <br /> Agencies regulating stormwater runoff. <br /> (1) Erosion control measures shall adhere to the standards established in the Minnesota <br /> Department of Transportation's Standard Specifications for Construction. The most <br /> recent"Stormwater Management"and"Erosion Control Handbook" shall be used as <br /> reference for diagrams,tables, and illustrations. <br /> (2) Design criteria used from the Minnesota Pollution Control Agency's"Protecting Water <br /> Quality in Urban Areas"may be used. <br /> (3) The appropriate pollution control measure for each site shall be determined by the City <br /> Engineer. <br /> (4) For"dewatering"activities,the water pumped from site shall be treated to reduce <br /> turbidity and sedimentation. <br /> (5) The nearest down gradient water body or drain inlet must be identified and protected <br /> prior to commencement of any site work. Drain or water body protection shall remain in <br /> place until site is stabilized. The City Engineer shall determine when a site is stabilized. <br /> Section 7-103 Exceptions <br /> Activities listed below shall be considered excepted by the standards in this chapter <br /> 1. Project approval received by either Rice Creek Watershed District,MPCA,DNR, or US <br /> Army Corps of Engineers <br /> 2. Building permits approved prior to the adoption of this ordinance <br /> 3. Any emergency work to protect life, limb, or property. <br /> Section 7-104 Construction Site Waste <br /> All waste and unused building materials shall be properly disposed of off site and not allowed to <br /> be carried by runoff into a receiving water body or storm sewer system.
