Also, <br />no residential development would occur on the adjacent property due to its extreme width. <br /> <br />Dick Peterson, Meritide, said the request is in conformance with the Comprehensive Plan in that the use would <br />be allowed in a B-2 District, and believes the unique circumstance is met. <br /> <br />There were no other comments from the audience. <br /> <br />CLOSE THE PUBLIC HEARING. <br />Motion by Schmitz, seconded by Zisla, to <br /> <br />6 Ayes - 0 Nays, Motion Carried. <br /> <br />WAIVE THE READING AND ADOPT THE RESOLUTION RECOMMENDING <br />Motion by Schiferl, to <br />DENIAL OF VN00-4. <br /> <br /> <br />Motion died due lack of a second. <br /> <br />Livingston agrees that approval would set precedence, but feels the small strip of residentially zoned land should <br />not be the reason for denying the application. <br /> <br />Zisla believes that legally this application is a reasonable way to utilize the property. <br /> <br />WAIVE THE READING AND ADOPT THE RESOLUTION <br />Motion by, seconded by, to <br />RECOMMENDATION APPROVAL OF VN00-4. <br /> <br /> <br />5 Ayes - 1 Nay (Schiferl), Motion Carried. <br /> <br />Teague presented a preliminary plat for development of four single family residential lots that would gain access <br />th <br />off 10 Ave. NW. The proposal meets all minimum code requirements for lot size, width and street access. <br />Staff does have concern over the lack of detail of proposed plans and would require detailed utility, grading and <br />drainage plans, and final plan showing legal descriptions of each lot and easements. <br /> <br />O’Brien verified that the lots exceed the width requirement. <br /> <br />Bruce Nedegaard, applicant, noted that the engineering plans will be submitted in the very near future. <br />Livingston asked the selling price of the homes. Nedegaard said the homes would be priced between $175,000- <br />$225,000. <br /> <br />nd <br />Robert Dorner, 981 2 St., was assured by the Planning Commission during the public hearing for construction <br />of the nearby church that there were no plans for residential development of this parcel. Since construction of the <br />church, his home has been flooded several times, and he does not believe there is room to construct four homes <br />on this parcel. <br /> <br />nd <br />Hilton Magnuson, 1040 2 St., agreed with Dorner’s statement that the parcel would never be developed, and <br />asked what will happen to the sanitary sewer running through the parcel. Teague said the development would not <br />disturb the sewer line. <br /> <br />nd <br />Tony Gesler, 1001 2 St., asked if these homes will meet the required setback from the creek and who will pay <br />the street assessment.
