Motion Carried. <br /> <br />WAIVE THE READING AND <br />Motion by Zisla, seconded by O’Keefe to <br />RECOMMEND APPROVAL TO THE CITY COUNCIL OF SP 01 – 014 <br />SUBJECT TO COMPLIANCE WITH THE FOLLOWING CONDITIONS: <br /> <br />1. There shall be no outside storage of a vehicle for more than 3 business days and <br /> no more than 15 vehicles stored overnight. <br />2. The applicant shall provide an updated site plan which shall include tree plantings for <br /> boulevard areas and appropriate additional plantings to serve as a buffer for the single <br /> family homes to the east of the site, approved by the city forester. <br /> <br />3.The applicant must submit a lighting plan showing lumen levels along the north <br />property line. Said on-site lighting shall not exceed .4 foot candles along the north <br />property line. Any additional parking lot or building lighting must be submitted for <br />approval by City Staff. <br />4. Sign plans shall conform to Sec. 9-080 and all other applicable regulations within <br />Chapter 9, Signs in the Zoning Code. <br />5. Applicant shall submit plans for rooftop mechanical equipment showing placement <br /> and screening . <br /> <br />6.Outside dumpsters shall be screened and shown on print. <br />7. Any new utility hook ups shall be done per approval of the City Engineer. <br />8. City shall require business to operate with doors closed if there is excess noise <br /> coming from the business or install other mitigation methods. <br />9. Hours of operation shall be limited to 7:00 a.m. to 8:00 p.m. Monday through <br /> Friday and Saturday from 8:00 a.m. to 4:00 p.m.. <br /> <br />5 Ayes, 2 Nays, Motion Carried. <br /> <br /> <br /> <br />Rezoning Three Vacant Lots Owned By Johnson Screens (PINs: 17-30-23-44-0002, <br />17-30-23-44-0003, 17-30-23-44-0004) from I-2, Heavy Industrial to MX, Mixed Use. <br />Mark Andrle, Community Development Specialist, explained that this is a rezoning that <br />would make the Comprehensive Plan consistent with the current zoning designations. <br />This particular proposed rezoning is for three properties just south of Johnson Screens <br />current building. They are currently zoned I-2 Heavy Industrial. The proposed new <br />zoning would be MX, Mixed Use. <br /> <br />The MX would be consistent with the Comprehensive Plan. There are two main reasons <br />the Comprehensive Plan calls for these properties to be MX, Mixed Use. One is the <br />character or the topography of these properties as they sit kind of high up on the hill, <br />overlooking Rush Lake. They are quite wooded and rather scenic. The second is that <br />this is kind of considered a gateway into New Brighton, coming off of 35 W and Hwy 96. <br />Mixed use development would be consistent with a gateway type development within the <br />City. <br /> <br />The staff’s recommendation is for approval of R01-4, rezoning of the three vacant lots <br />from I-2 , Heavy Industrial to MX, Mixed Use. <br /> <br />
