<br />3.No commercial or home occupation activity shall be conducted within the <br />accessory building. <br /> <br />4.The City Manager will make a determination of front yard / back yard of this <br />residential riparian lot. <br /> <br /> Motion Carried. <br />6Ayes, 0 Nays, <br /> <br />Public Hearing: SP 04-10 Special Use Permit for a proposed front yard <br />encroachment - Ms. Jennifer Tenenbaum <br />Consideration of an application for a Special Use Permit to construct an addition onto the <br />existing home at 2015 Long Lake Road NW. The site is zoned R-1, Single Family <br />Residential. The proposed addition encroaches into the required 30 foot front yard <br />setback. Section 4-040 (3) B states that in required front yards, the required setback may <br />be reduced to twenty-four feet subject to the approval of a Special use Permit and <br />conditions found in Section 4-040 (3) B 1-4. The applicant is proposing to add onto the <br />kitchen, which is proposed to encroach into the front yard setback by 2 feet. This <br />addition is part of a larger project where a second story is planned to be built. <br /> <br />Mr. Boylan reviewed the background information and site plan for the Commissioners <br />and audience. The applicant was present. No one wished to speak to the issue from the <br />audience. <br /> <br />Motion by Baker, second by O’Brien to <br />CLOSE THE PUBLIC HEARING. <br />Motion Carried. <br />6 Ayes, 0 Nays, <br /> <br />Hearing no further discussion, Motion by Mann, second by Howard, to <br />WAIVE THE <br />READING AND ADOPT THE ATTACHED RESOLUTION, RECOMMENDING APPROVAL OF <br />SP 04-10. <br />Motion Carried. <br />6 Ayes, 0 Nays, <br /> <br />Public Hearing: SP 04-12 / NC04-04 – Special Use Permit for a proposed detached <br />garage larger than 464 sq. ft.. – Mike and Janell Zappa. <br />Consideration of an application for a Special Use Permit to construct a garage larger than <br />rd <br />624 sq. ft. on a single family lot at 721 3 Avenue NW. The site is zoned R-1A, Single <br />Family Residential. The applicant wishes to expand the existing detached garage to a <br />total of 1,038 sq. ft. <br /> <br />Mr. Boylan reviewed the background information and site plan for the Commissioners <br />and audience. The applicant did not submit detailed elevation drawings of the attached <br />garage. The applicants were present. No one in the audience spoke to the issue and staff <br />had received no communications about the proposal. <br /> <br />Motion by Baker, second by O’Brien to <br />CLOSE THE PUBLIC HEARING. <br />Motion Carried. <br />6 Ayes, 0 Nays, <br /> <br />There was some additional discussion among the Commission regarding the roof and <br />overall design of the garage.
