This type of use is not currently allowed in the B-3 General
Business District. Staff believes that outdoor dining in conjunction with a properly licensed food
establishment should be regulated through a special use permit process. The amendment would
read as follows: 15) Outdoor dining in conjunction with a licensed food establishment. Adequate
screening, fencing and/or other requirements may be imposed to ensure that such use does not
have a detrimental impact on adjoining properties or the general public.

The Commission directed Staff to check with the City Attorney to see what the impact would be
on existing outdoor dining in different zoning districts.

CLOSE THE PUBLIC HEARING.
Motion by Zisla, Second Howard by to

MOTION CARRIED.
5 Ayes, 0 Nays,

Motion by Zisla second by Schiferl to
After further discussion,
ACCEPT STAFF
05-09.
RECOMMENDATION OF ZA

MOTION CARRIED.
5 Ayes, 0 Nays,

General Business:
No General Business.

I:\COMMISSIONS\PLANNING\Minutes\2005\12-20-2005.doc
