<br />Approved <br />the whole city, not just in the Northwest Quadrant, although the new development is a perfect <br />place to start. He also added that while there are not specific sites selected, they will be making <br />areas available for the public art. Zisla replied that he will write a condition of approval. Baker <br />added that he would like to see in that a statement on who will have the final say on what goes <br />into those spaces. <br /> <br />Schiferl had passed out a letter addressing his concern about the sustainability of the development <br />and is concerned that he heard very little from the Developers on how they will be implementing <br />the design guidelines in regards to green use and recycling. He added that the Developers are <br />starting the process of an energy audit, but that the results would be available after the approval <br />process for the development is complete. He is concerned that if this site plan is approved, then <br />the Developers will not be held accountable for addressing these concerns, which they are in <br />principal agreeing to do. Baker inquired if these concerns should be addressed in the <br />development agreement and not in the site plan. Schiferl replied that he has questioned how the <br />Design Guidelines were going to be enforced. He is confused why the guidelines are not being <br />applied to the residential area now, when in November of 2005 they were told that they were <br />going to be. He would like a commitment from the developers that they will be addressing the <br />sustainability of the development and how they will be addressing the green uses and recycling. <br /> <br />Phil Carlson, DSU Companies, stated that the Design Guidelines are intended to apply to the <br />entire Northwest Quadrant, including the residential area. The Design Guidelines would be <br />implemented in several ways, one of which is to create a whole new zoning district. After <br />looking at the new zoning district, they realized that much of it does not apply to the residential <br />district; however that does not mean that the residential area does not need to follow the Design <br />Guidelines. Schiferl stated that he does not know how to incorporate those guidelines, because <br />there are no specifics on how they will be implemented. Baker stated that is not something that <br />the Planning Commission would address; the City would have to address them. Schiferl replied <br />that they could be part of the Planning Commission, and that the original concept was that the <br />guidelines would be part of this process. Fernelius stated that the Design Guidelines were created <br />with the more of east side of the development in mind than the residential area. The residential <br />Developers were given a copy of the Design Guidelines and are incorporating some, but not all of <br />them. He added that trying to incorporate all of the guidelines into an ordinance may not be <br />necessary. He doesn’t want to give the impression that staff or the Developers have ignored the <br />Design Guidelines, because that is not the case. Schiferl replied that he did not mean that the City <br />or developer has ignored the guidelines, but that the portion of the guidelines that deal with the <br />environment is not addressed at all. He also added that the guidelines do address both sides of <br />Old Hwy 8 and not just the east side. Fernelius responded that the guidelines that were adopted <br />by the Council in January do apply to the whole development, but the new zoning code that DSU <br />is drafting is for the east side. Schiferl stated that the point he is trying to make is that while the <br />City controls this property they can state that the Developers have to include sustainability and <br />uses of green resources. He stated that this can be done in several different ways: codifying the <br />Design Guidelines, putting it into the Developers agreement, or by having the Developers list <br />what they will be doing and how they will implement that plan. Baker stated that these concerns <br />should be addressed by staff and the Developers, and that it is not appropriate for the Planning <br />Commission. Zisla replied that it may be an appropriate time to deal with this issue. Baker <br />responded that the Planning Commission deals with zoning issues, and not environmental design. <br />Fernelius stated that staff is looking for direction on what sustainable principals the Commission <br />would like to see incorporated.
