Approved
could work, and then they will never know. O’Brien inquired from staff if they take a
commercial use off the list, could it affect a potential client from building in the area.
Fernelius replied that it definitely could, however they could approve a non listed use
through a special use permit. Zisla inquired what standards would be used for a special
use. Fernelius replied that they would use the same standards that are currently in the
Zoning Code. O’Brien asked if they could state that all commercial uses are subject to
the approval of the City Council and then let the market place and the Council decide
what is appropriate. Schiferl stated that the problem with that is that if a tenant moves,
the property owner will have to go before Council for every new tenant. Baker inquired
if they could add a descriptive paragraph of what they are looking for into the guidelines.

The Commission suggested that the following changes to the commercial use list. These
uses would be for the first floor only or A2:
?

Section F and S: Pet shop would require a special use permit.
?

Section G: Strike hardware store, grocery store (this is already in section A).
?

Section K: Motel or hotel would require a special use permit.
?

Section L: Day school/nursery would be allowed in A1 only.
?

Section M: Amusement/recreation would be allowed in A1 only.
?

Section O: Apparel sale of all kinds was combined in Section J’s dry goods.
?

Section P: Furniture would be allowed with a size restriction on the store.
?

Section Q: Strike service establishments from this section.
?

Section R: Strike this section.
?

Section T: Strike this section.
?

Section U: Pet hospital would require a special use permit; Racquet ball club
could be tied into Section M, change the name from racquet ball club to health
club and would require a special use permit.
?

Section V: Strike this section.

The Commission suggested that the following changes to the office use list. These uses
could also be used in the A2 area on the second and third floors.
?

Section A: Medical clinic would be allowed only in A1
?

Section C: Trade school would be allowed with a special use permit.

O’Keefe inquired to how many square feet is allowed for the A2 area. Fernelius replied
that there would be 15,000 to 20,000 square feet total. O’Keefe stated that he had a
vision of three to four shops on each side of the street, and now is wondering if that will
be possible with the allowed square footage, he does not want to see one large shop on
either side. Baker inquired if they could add a description that basically states no “big
box” retail shops directly into the Intent section. Carlson replied that they could do that
by limiting the square footage.

Schiferl inquired if a resident is in a three story building, would they be able to see the
mechanical equipment of a two story building that was near by.
