Approved

MOTION CARRIED.
7 Ayes, 0 Nays,

to
Motion by O’Brien, Second by Zisla
WAIVE THE READING AND ADOPT THE ATTACHED
SP2006-006, subject to the following
RESOLUTION RECOMMENDING APPROVAL OF
conditions
:

1.The proper business license is obtained with the City Sanitarian.

2.The applicants submit the required Special Use Permit processing fee of $200.

7
MOTION APPROVED.
Ayes, 0 Nays.

PL2006-001, VA2006-002 Preliminary Plat and Right-of-Way
Public Hearing:
thst
Vacation for Property at Northwest Corner of 5 Avenue NW & 1 Street NW

Zisla recused himself from this public meeting discussion.

The City of New Brighton is requesting a preliminary plat, which ultimately will include
th
a right-of-way vacation, for property located at the northwest corner of 5 Avenue NW
st
and 1 Street NW. The City currently owns the property located to the east of the
th
existing, undeveloped right-of-way known as 6 Avenue NW. Bell Pole & Lumber owns
the property to the west of that right-of-way. The preliminary plat will create three lots
on one block to be known as BRIGHTON CORPORATE PARK VII. The right-of-way
vacation is needed in order to re-plat the property and facilitate redevelopment.

Following approval of the preliminary/final plat and right-of-way vacation, the City will
continue its pursuit of a land swap will Bell Pole & Lumber. The land swap will result in
Bell Pole & Lumber acquiring proposed Lot 3 with the City acquiring all of proposed Lot
1 and Lot 2. Currently, Bell Pole & Lumber occupies all of the land to the west of the
dedicated right-of-way proposed for vacation. Following the land swap, all of Bell’s
operations will move to proposed Lot 3. This allows the City to sell proposed Lot 2 to
Ryan Companies for future construction of the carrier annex, in conjunction with
relocation of the post office from the Northwest Quadrant. It is anticipated that proposed
Lot 1 would be sold to Dalco Companies to the north.

Baker inquired if Bell Pole would continue operating on the property. Gundlach replied
that they would move their pole storage to lot three, the southern lot. O’Keefe inquired if
Bell Pole is storing their poles on the right of way by permit. Gundlach replied that she
did not know the answer to that question. O’Keefe inquired if there is any environmental
protection of anything being left behind when the poles are removed and we vacate the
right of way. David Black, Assistant Community Development Director, replied that the
city is working with the NCPA and the EPA to extend a prior agreement to cover the
clean up of this area, so the City is not a risk.

I:\COMMISSIONS\PLANNING\Minutes\2006\05-16-2006 MINUTES.doc Page 12 of 13
