<br /> <br /> Approved <br />PLANNING COMMISSION PROCEEDINGS <br />CITY OF NEW BRIGHTON <br /> <br /> <br />Regular Meeting – September 19, 2006 at 7:00 p.m. <br /> <br />Present: <br />Commissioners Larry Baker, Bruce Howard, Karen Mann, Jim O’Brien, <br />Norm Schiferl, and Paul Zisla. <br /> <br />Absent: <br /> Tom O’Keefe and Commissioner Sharon Doffing. <br /> <br />Also Present: <br />Grant Fernelius, Community Development Director. <br /> <br />Agenda Review: <br />Agenda approved. <br /> <br />Approval of Minutes <br />: The August 15, 2006 was approved. <br /> <br />Council Action: <br /> No Council report given. <br /> <br />Announcements: <br />Fernelius reported that Janice Gundlach, City Planner, had her baby <br />and he will be covering her duties while she is on maternity leave. <br /> <br />Public Hearings: NC06-01 Type 4 Non-Conforming Use Permit for allowing <br />construction o f additions to the home where the front yard setback is 29’ where 30’ <br />is required. <br /> <br />The subject site has a single-family home that encroaches into the front yard setback and <br />a shed that encroaches into the side yard setback; the owner wishes to construct an <br />addition to the house and garage. The proposed addition does not encroach into any <br />required setback and the applicant has stated that they will move the shed to meet setback <br />requirements, thus reducing the number of non-conformities on the site. Staff believes <br />issuance of a Type-4 Non-Conforming Use Permit is appropriate under these <br />circumstances. It appears the addition will enhance the home and will not have a <br />detrimental appearance upon adjacent properties or the neighborhood in general. <br /> <br />Baker inquired if the house was built with a variance or if the twenty-nine foot setback <br />was an error during construction. Fernelius replied that it appears it was a construction <br />error, but staff was unable to confirm this theory. Eleanor Carlson, homeowner, stated <br />that the addition is for family members that are moving in. She added that the shed will <br />be demolished. Schiferl asked if Carlson knew why the house was constructed one foot <br />over the setback.
