<br /> <br /> <br /> <br /> <br /> <br /> RESOLUTION NO. <br /> 07-052 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEw BRIGHTON <br /> RESOLUT N MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT, <br /> WHEREA , an application has been made Buell Consulting, Inc, on behalf of Verizon Wireless to <br /> permit nstruction of telecommunications equipment, including a 13.4' x 20' equipment shelter <br /> and 8 nnas, at 675 Forestdale Road, also known as 700 Silver Lake Road. <br /> WHEREA the procedural history of the application is as follows: <br /> 1. Ap cation for a Special Use Permit was received on April 26, 2007. <br /> 2. The lanning Commission, pursuant to published and mailed notices, held a public hearing <br /> on ay 15, 2007 and all present were given a chance to freely speak at the hearing. <br /> 3. The lanning Commission recommended approval on May 15, 2007. <br /> 4. Th ity Council considered the request on May 22, 2007. <br /> <br /> WHERE , the Planning Commission and City Council make the following Findings of Fact with <br /> respect the Special Use Permit (SP2007-004): <br /> 1. Th roperty is zoned R-1, Single Family Residential. <br /> 2. Th roperty is guided in the Comprehensive Plan for Low Density Residential. <br /> 3. Th property is legally described as follows: <br /> Tra A, Registered Land Survey No. 44, Files of Registrar of Titles, County of Ramsey, State of Minnesota. <br /> Be' registered land as is evidenced by Certificate of Title No. 155858 and the South 255 feet of the East 170 <br /> fee f the Northeast one-quarter (NE '/4) of the Northwest one-quarter (NW '/4) of Section 30, Township 30, <br /> e 23, according to the United States Government Survey thereof and situate in Ramsey County, Minnesota. <br /> 4. Se ion 4-600 (2) establishes the following building permit criteria for telecommunications <br /> eq pment: <br /> a. 11 towers and antennae shall have setbacks equal to or greater than the height of the <br /> roposed structure. <br /> b. The distance of any guy anchorage or similar device shall be at least ten feet from any <br /> property line. <br /> c. Suitable protective anti-climb fencing and a landscape planting screen shall be provided <br /> and maintained around the structure and accessory attachments. <br /> d. The applicant shall present documentation of the possession of any required license by <br /> any Federal, State, or local agency. <br /> e. No structure shall be in excess of a height equal to the distance from the base of the <br /> structure to the nearest overhead electrical power line which serves more than 1 dwelling <br /> or place of business, less five feet. <br /> f.
