RESOLUTION NO. 07-052 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEw BRIGHTON RESOLUT N MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT, WHEREA , an application has been made Buell Consulting, Inc, on behalf of Verizon Wireless to permit nstruction of telecommunications equipment, including a 13.4' x 20' equipment shelter and 8 nnas, at 675 Forestdale Road, also known as 700 Silver Lake Road. WHEREA the procedural history of the application is as follows: 1. Ap cation for a Special Use Permit was received on April 26, 2007. 2. The lanning Commission, pursuant to published and mailed notices, held a public hearing on ay 15, 2007 and all present were given a chance to freely speak at the hearing. 3. The lanning Commission recommended approval on May 15, 2007. 4. Th ity Council considered the request on May 22, 2007. WHERE , the Planning Commission and City Council make the following Findings of Fact with respect the Special Use Permit (SP2007-004): 1. Th roperty is zoned R-1, Single Family Residential. 2. Th roperty is guided in the Comprehensive Plan for Low Density Residential. 3. Th property is legally described as follows: Tra A, Registered Land Survey No. 44, Files of Registrar of Titles, County of Ramsey, State of Minnesota. Be' registered land as is evidenced by Certificate of Title No. 155858 and the South 255 feet of the East 170 fee f the Northeast one-quarter (NE '/4) of the Northwest one-quarter (NW '/4) of Section 30, Township 30, e 23, according to the United States Government Survey thereof and situate in Ramsey County, Minnesota. 4. Se ion 4-600 (2) establishes the following building permit criteria for telecommunications eq pment: a. 11 towers and antennae shall have setbacks equal to or greater than the height of the roposed structure. b. The distance of any guy anchorage or similar device shall be at least ten feet from any property line. c. Suitable protective anti-climb fencing and a landscape planting screen shall be provided and maintained around the structure and accessory attachments. d. The applicant shall present documentation of the possession of any required license by any Federal, State, or local agency. e. No structure shall be in excess of a height equal to the distance from the base of the structure to the nearest overhead electrical power line which serves more than 1 dwelling or place of business, less five feet. f. Only one such structure exceeding the district height limitations shall exist at any one time on any residentially zoned and used lot or parcel.
